Trump launches thunderbolt as Beijing’s worries loom

The core of the statement is that Trump will, in accordance with the Constitution, maintain the state of national emergency declared after the revision of Executive Order 12938 for one year. Trump then gave notice of his own executive order in a letter to the Speaker of the House of Representatives and the President of the Senate, explaining why.

That the executive order was “in response to the growing threat to U.S. capital development posed by the People’s Republic of China (PRC), which has enabled the PRC’s military development and modernization, endangered U.S. intelligence and other security agencies, and continues to allow the PRC to directly threaten U.S. forces on the U.S. homeland and abroad, including through the development and deployment of weapons of mass destruction, advanced conventional weapons, and malicious cyber operations against the United States and its people.

According to the White House website, the full title of the executive order is “Executive Order on Addressing the Threat from Securities Investments that Finance Communist Chinese Military Companies.

In the Executive Order, Trump first described the Communist Party’s threat to the United States and then pointed to the Communist Party’s strategy of military-civilian integration, noting that private Chinese companies, in addition to directly supporting and helping to develop the Communist Party’s military, intelligence, and security apparatus, have also used U.S. investors to finance their military development and modernization.

In response, Trump declared a national emergency regarding this threat and ordered the following: beginning at 9:30 a.m. Eastern Standard Time on January 11, 2021, any U.S. person is prohibited from engaging in any transaction with any publicly traded securities of any PRC military company, or any derivative securities, or securities designed to provide investment risk. Investors have until 11:59 p.m. on November 11, 2021 to withdraw any investment that includes these PRC securities. These are companies that have been or will be listed by the Department of Defense pursuant to Section 1237 of Public Law 105-261, as amended, or that have been determined by the Secretary of the Treasury using similar criteria to be PRC military companies or their subsidiaries. The Executive Order also prohibits any transaction by a U.S. person or within the U.S. that has the purpose of evasion and results in a violation or attempted violation of the prohibitions set forth in the Order.

Kawakami and authorizes the Secretary of the Treasury to consult with the Secretary of State, the Secretary of Defense, the Director of National Intelligence, and the heads of other appropriate executive departments and agencies; the list of entities to be sanctioned is made by the Departments of Defense and Treasury. To date, the U.S. Department of Defense has designated 31 Chinese companies backed by the Communist Party of China (CPC), including: 20 top Chinese companies such as China Telecom, China Mobile, Huawei, Aviation Industry Corporation of China, China Railway Construction Group, China Shipbuilding Industry Corporation, Panda Electronics Group, and Hikvision, as companies owned or controlled by the CPC military. More companies will undoubtedly be added to the list later.

A U.S. state of national emergency is usually a temporary state of severe criticality that is imposed nationally or locally by a series of special government initiatives in times of crisis. It is usually declared for an indefinite period of time in the event of a national defense crisis, war, or epidemic emergency. A president wishing to activate this right need only issue a public declaration of a national state of emergency.

According to statistics, since the enactment of the National Emergencies Act, successive U.S. presidents have declared 61 states of national emergency, of which more than 30 are still in effect. Such as in 2001, after the United States suffered the “9-11” terrorist attacks, President George W. Bush declared a national emergency and exercised a series of emergency powers, while Trump has previously declared five “national emergency”, the fourth is in 2019.
