Alan Dershowitz, a retired Harvard University law professor, said the U.S. Supreme Court’s decision Friday (Dec. 11) to dismiss Texas’ case against the four swing states for lack of standing to bring the case shows the court does not want to get involved in the election.
In an interview with Newsmax TV host Grant Stinchfield, Dershowitz agreed with Justice Samuel Alito and Justice Clarence Thomas that Texas does have standing.
Dershowitz said the Supreme Court just didn’t want to deal with, what might be considered, matters of a political nature.
After the court announced its order, Justices Alito and Thomas issued separate statements saying, “In our view, we have no authority to deny a petition that falls within our jurisdiction.”
But they also said, “The motion to file the petition is granted, but no other relief (relief) will be granted and no opinion will be expressed on any other issue.”
“This decision by the Supreme Court sends a message,” Dershowitz said, “that the majority includes three justices appointed by President Trump, all of whom have said ‘we’re not going to hear Texas cases, we’re not going to get involved in this election ‘”
He further stated, “I think it sends a message. It’s not a legal message, but it’s a realistic message: the Supreme Court doesn’t want to get involved in this election battle.”
The Texas lawsuit alleges that officials in Pennsylvania, Wisconsin, Michigan and Georgia, allegedly used the viral outbreak to illegally change election statutes, and he asked the federal Supreme Court to declare the election results in the four states unconstitutional. The counting of votes cast by the electoral college in the four states is prohibited; for the defendant states that have already appointed electors, the court directed the state legislatures to appoint new electors in accordance with the Constitution.
By weakening laws designed to curb fraud, officials in the four states deprived citizens of Texas and other states of equal protection for their votes, the lawsuit said.
Although the Supreme Court said the rights of citizens in other states have not been harmed by the actions of officials in the four states. But Dershowitz said he believes the argument is valid.
Dershowitz said that because the Electoral College vote is coming up on Monday, the most important thing for the Trump team right now is that “time is not running out.
“But I want to congratulate the (Trump) lawyers, they’ve done a great job of bringing this case to court in a creative way and bringing it to the attention of the American people.” Dershowitz said.
