Floyd judge says Waters’ violent rhetoric will overturn “entire trial.”

The Breitbart News reports that Judge Peter Cahill in the Floyd case on Monday, April 19, slammed Rep. Maxine Waters (D-CA) for her comments Saturday that Rep. Waters has no respect for the rule of law and is abhorrent. Rep. Waters said there should be unrest everywhere if the jury fails to convict Officer Shovan in the Floyd death case.

Officer Shovan’s defense attorney, Eric Nelson, filed a motion to declare a mistrial after closing arguments because of Rep. Waters’ comments. Judge Cahill denied the motion, but agreed that Waters’ comments were so egregious that, in the event of a murder or manslaughter conviction against Shovan, Waters’ violent comments could result in “the entire trial being overturned” if an appeal is filed.

I am aware of the media coverage, and I know that Congresswoman Waters specifically spoke about the trial and how she could not accept a not guilty verdict for murder, and said she would fight it, and published articles in the media. I hope elected officials will stop talking about this case, especially in a way that does not respect the rule of law, the judiciary and the judicial function. If they’re going to speak out, they should do it in a respectful way, in a way that respects the Constitution, respects the co-equal branches of government, but they’re not doing that. Officer Shovan, faces charges of second-degree unintentional murder, third-degree murder and second-degree manslaughter, to which Shovan has refused to plead guilty. If convicted, Shovan faces up to 40 years in prison for second-degree murder, up to 25 years in prison for third-degree murder and up to 10 years in prison for second-degree manslaughter. Shawan has no prior convictions, and the U.S. media expects that even if convicted, the specific sentence will be less than the maximum sentence.
