Investigators say the Capitol officer who shot and killed Ashli Babbitt should not face charges, the National Archives reports.
The Wall Street Journal reports that a preliminary ruling determined the officer will not be charged.
Investigators looking into the fatal shooting of Ashli Babbitt by Capitol police officers have concluded that the officer should not be charged.
Sources familiar with the situation told The Wall Street Journal that investigators behind the preliminary investigation into the Jan. 6 killing of Ashli Babbitt by a police officer during a Capitol Hill protest have recommended that the man not face any charges for her death.
Babbitt, a 35-year-old U.S. Air Force veteran who served four tours of duty, was shot and killed by the officer as she entered the Capitol with hundreds of others. Her husband described her as “a strong supporter of President Trump and a great patriot to all who knew her.
A witness told the National Archives that Babbitt was unarmed when she climbed onto a window ledge near the Senate floor and was shot.
“When she got her feet on the ledge, her hands were on either side of the window and there was a man inside, not in uniform, he was wearing a suit and fired a shot that hit her in this area [referring to the neck]. She fell out of the window. The police officer who was there wouldn’t let me help. I’m trained in emergency medical services, and they wouldn’t let me assist… They pushed me out of the way and I stood there and watched this young lady die.”
The Capitol police officer responsible for her execution-style killing was placed on leave pending an investigation. There is also an investigation into whether Babbitt’s civil rights were violated by the officer.
In its initial announcement, the Justice Department stated that the investigation was a “routine procedure” following the use of deadly force by D.C. police.
The report clarified that DOJ officials still need to make a final decision on the case. The Justice Department has not yet commented on the report.
