Law professor involved in former impeachment case: impeaching Trump would undermine the Constitution

In response to the impeachment motion initiated by Democrats, Jonathan Turley, a lawyer who was involved in the 2019 impeachment hearings, said President Trump did not have inflammatory language in his speech to his supporters before the incident that rocked Congress. He warned that continuing to push the impeachment agenda would cause long-term damage to the U.S. Constitution.

In an opinion piece in The Hill on Saturday (Jan. 9), he noted that a swiftly initiated new impeachment would undermine the U.S. Constitution.

According to the article, the Democratic Party seeks to launch a second impeachment against Trump for sedition, which would completely destroy not only the constitutional standard for impeachment but also the freedom of speech in the U.S. This action, taken just days before the end of Trump’s term, is hasty and crazy.

He pointed out that the Democrats want to remove Trump based on the speech he gave to supporters before he stormed Congress, but that Trump’s speech does not meet the definition of “incitement” under the criminal code and would be considered a protected speech by the Supreme Court.

Turley, who is not a Trump supporter, acknowledged that while Trump’s speech was widely and “justifiably” condemned, it is true that he never called for violence or riots. Trump urged supporters to ask members of Congress to oppose certifying the Electoral College vote results, but he told the crowd to “let your voices be heard in a peaceful and patriotic way.

Turley also noted that Democrats have challenged the electoral vote in the past on the basis of the law, and that Trump called on the crowd to “walk down Pennsylvania Avenue,” a march that is a common form of protest in the United States. Trump did not call for illegal action, he only called for people to protest in front of Congress.

The article further notes that, in addition, violence was not imminent, as the vast majority of the thousands of protesters were not violent prior to the march, and most did not riot inside the Capitol. Like many violent protests over the past four years, the crimes were committed by only a small group of instigators. The Capitol Police were aware of the march, but declined help from the National Guard because they thought violence was unlikely.

Turley argued that Trump’s statements are covered by the First Amendment, so for Congress to now seek to impeach him for those statements would set a precedent that any president can be impeached for using reckless language that triggers accusations of violence by others.

Turley commented that the basis for impeachment, as advocated by Democrats, is more extreme than an infamous 1919 U.S. Supreme Court decision that would ultimately cause long-term damage to the U.S. Constitution.

In terms of public opinion right now, as you can predict, is that because the mainstream media is so hateful of Trump and the mainstream media is controlled by Democratic politicians, they are ready to blame Trump for the riots.”

I worry for this country when those Internet oligarchs censor the speech of the President of the United States.

I worry for this country when I see that billionaires like Zuckerberg can spend $400 million to buy municipalities simply to maximize turnout in certain Democratic districts, in total disregard of election-related laws.

When I read that Apple has an ironclad ‘never piss off China’ rule, and when I see the NBA cave in to China, I worry for this country. When I see news after news of election fraud coming out and no media attempt to investigate, I know something is very sick.

The entire election process was the last straw that broke the camel’s back, accelerating and deepening the crisis of confidence in America. Beyond the obvious fraud, there were shocking things, any one of which could have rewritten the election results.

In every swing state, officials violated local laws and sent ballots to every registered voter. All of this behavior was clearly documented in the Texas lawsuit, only to be dismissed by the Supreme Court on the grounds of procedural noncompliance, not because of the lawsuit itself. This is what this election really looks like.

Meanwhile, it is clear that every swing state did not follow the normal process of validating mail-in ballots. Compared to previous elections, this year’s ballot invalidation rate is ridiculously low. In Georgia, the voiding rate dropped from 6.5% in 2016 to 0.2% this year. In Pennsylvania, it dropped from 1 percent in 2016 to 0.003 percent this year. Nevada dropped from 1.6 percent to 0.75 percent. There is only one explanation: they received a lot of ballots that should have been voided in previous years, and the mail-in ballots favored Biden. This is what this election really looks like.

For four full years, the entire establishment was mobilized to boycott the elected president, as if they were the immune system that was wiping out the virus. Now they are turning around and saying we are destroying democracy.

If Biden had ruled the country the left-wing way, which he would almost certainly have been forced to do, the numbers would have been higher and we would have won big (midterm elections) in 2022.

In this case, I have no interest in endorsing as President of the United States a man whose son has been bought by a rival state. I’m also not interested in pretending to recognize the election results as legitimate. This is just the elite system lingering on the manipulation of the media. This election is about those who broke the law, those who cheated the country, and those who hurt those of us who believe in the American spirit, who respect history, and who respect freedom of speech.

As I write these words, I am truly saddened because I believe that America is headed for a deep and troubling situation. This extraordinary, four-year, carefully planned power struggle threatens the very foundation of our nation and the freedom of every American citizen.
