Fast Facts: Texas Prepares Lawsuit Against Incoming Joe Biden Administration

The San Antonio Express-News, a Texas media outlet, reported on Jan. 15 that the state of Texas is preparing various lawsuits against the incoming Joe Biden administration.

The article writes that Joe Biden vowed to “roll back the Trump administration’s crackdown on immigration, push for climate change policies and amnesty for thousands of American students in debt within the first 100 days of his administration.” Joe Biden also said he would advocate for a mandatory mask policy and wants Congress to pass another massive stimulus package.

The report continues, “In the long run, Biden has discussed rewriting the tax code to raise taxes on the wealthy.” The report adds, “Texas will almost certainly fight Joe Biden’s policies every step of the way.”

Texas is about to return to the front lines of the fight against the federal government, in the tradition of Texas Republican leaders, as did Rick Perry, who served as Texas governor from 2000-2015, and current Gov. Greg Abbott, who was Texas attorney general before becoming governor and famously said. “I go to work, I sue the federal government, and then I go back to work.”

Ken Paxton, the current Texas attorney general, is also committed to overturning federal laws and orders embraced by the Democratic Party. Most recently, he led the effort to challenge Joe Biden’s election results in four battleground states before the Supreme Court.

With Joe Biden taking office on Jan. 20, many expect Texas to revive dozens of cases against the Obama administration, such as the Clean Power Plan, the repeal of Obama’s protections against trafficking of children into the country illegally, and the end of Obamacare (the Affordable Care Act).

In a tweet on Sunday, Governor Abbott shared this Newsmax article and commented, “A new series of Texas-led lawsuits awaits Gov. Joe Biden. Texas takes action every time the federal government infringes on states’ rights or interferes with constitutional rights, private property rights or the right to earn a living.”

Meanwhile, a recent national survey shows that most Republicans want congressional leaders to challenge Joe Biden on important issues.

Fox News reports, “In a Pew Research Center poll, nearly 6 in 10 (59 percent) Republicans urged congressional Republican leaders to stand up to Joe Biden, even if it is more difficult to solve the major problems facing America.”

Robert Henneke, general counsel for the conservative Texas Public Policy Foundation (TPPF), told Newsmax, “Lawsuits against the unconstitutional actions of Joe Biden’s administration will be the focus.” He concluded, “If the new administration tries to exceed the scope of its constitutional powers or create policies and rules that are not supported by data and science, I hope we will play a significant role in challenging those types of policies.”
