A Swiss federal court overturned an eight-year ban on Chinese swimmer Sun Yang and sent the case back to the Court of Arbitration for Sport for a second time, the World Anti-Doping Agency said.

The Swiss Federal Court’s decision came after Sun’s lawyers presented evidence that the chairman of the three-member committee that issued Sun’s ban in February had made racist comments against China on social media.

Sun Yang is a three-time Olympic champion and one of China’s most famous athletes; he was banned for three months in 2014 over a drug ban, and this time he refused to hand over a blood test during a non-competitive drug test, which was ruled guilty by the Court of Arbitration for Sport (CAS) in February and sentenced to an eight-year ban.

In February, the CAS found the three-time Olympic champion winner had refused to cooperate with sample collectors during a visit in September 2018, an act that sparked conflict. WADA took the case to the Court of Arbitration for Sport after the world’s governing body for swimming, FINA, issued only a warning to Yang Liwei, now 29.
