I have been engaged in HR for more than ten years, and I have dealt with many work-related injuries. In my earlier years, I was always indignant that employees were not treated properly because they did not know the law, but in recent years, I found that some employees were more familiar with labor law than I was. And over-understanding often leads to over-utilization. High compensation for workplace injuries seems to have become a new shortcut to wealth. In some people’s eyes, like an opened Pandora’s Box, it starts with chance and quickly turns accidents into necessity. The most helpless thing is that, unlike professional fraudulent insurance scammers, they are down-to-earth, hard-working and kind, they have suffered, so they are not afraid of suffering, they regard injuries as a common occurrence, and see compensation as a quid pro quo. But never thought about what the consequences of doing so are. Fang is such an “easy” injured female worker.

On the third day of the Chinese New Year in 2018, in a small town in XX County, Jiangxi Ganzhou, every family was busy welcoming and visiting friends and relatives, but Fang didn’t even go to her mother’s house, just running back and forth between the village and the town to arrange her son Feng’s wedding.

This is the fourth work injury that Fang has suffered in the past seven years, and it is also the most serious one. The team leader said that for every new employee she brought out, she would be rewarded with 500 yuan.
But Fang had just brought in a new employee for less than half a month when something happened.
She was working on the night shift that day, teaching the newcomer how to use the mold. During the demonstration, somehow, the machine that had stopped suddenly started up, and the reel rolled quickly and ran over Ah Fong’s left hand, which was originally placed by the axis. The witness testimonies on the injury report all said it was an accident, and only Fang himself knew that it was not.

Fang has been operating this extruder since the day she joined the factory. What Fang is not convinced about is the time in 2013.
In 2013, she entered a private owner of the hardware factory, looks quite formal, did not expect even social security is not given to buy. She thought that anyway, she came in, the salary is also okay, simply do it in the head. After working for half a year, when she was dragging the parts to the spraying area, the crate hooked to the wire on the side of the aisle and fell down, hitting the back of her foot.
At the beginning, the factory was sent to the hospital to take a film to see the doctor, said it was a comminuted fracture, surgery and steel nails, wrapped in a cast to recuperate for two months. But after recovery, Fang wanted to apply for work injury identification, but the factory refused.
She went to the personnel, who said she could not report her injury without social insurance. She went to the boss again, who replied coldly: “Do what work injury identification, since the injury is healed, come back to work, now the factory is very busy, do not just get paid not to work.”
She argued a few sentences, saying to the effect that I had been injured at work and the factory could not care less, and the labor law stipulated that I had to pay for my injury.
The boss laughed coldly: “You talk to me about labor law, then I ask you, do you want to pay for the tens of thousands of dollars worth of parts that you broke? Your own work errors, delayed the production schedule, I did not look for you to settle accounts, you dare to ask me for compensation? Do you think I am one of those small factories with no access? I’m not afraid to tell you, I’m very familiar with the director of the Labor Bureau.”
The boss’s wife was very nice and said softly, “I don’t blame the boss for being angry. You were accidentally injured, the factory helped you to cure, did you have to pay a penny? You haven’t worked a day in the past few months, did you get a penny less in wages? Now you say the injury is healed, the factory said not to let you do not? Neither. With such a serious injury, 20,000 yuan was enough to send her away. If she had applied for disability appraisal according to the normal process, she would have been able to get at least a ninth-grade appraisal with reference to the first work injury. 19 months of salary, 80,000 to 90,000 yuan was lost. Later, I heard that it was a crime not to buy social security, and a lawsuit would be filed, and the compensation would probably be more than 100,000 yuan.
When she thinks about it now, her intestines are blue with regret. This lesson Fang can never forget, she thought, she also blame her ignorance of the industry, if the old Feng in the words, the two people have a discussion, and not even a single force to argue with no one.
Since then, Feng has to enter a factory with her. And before entering the factory, the two families have to ask whether to sign a contract, to buy social security, she does not want to suffer for nothing and nothing to get.

This time, Fang was lucky to be injured at work.

Forty-five days later, the result of the disability evaluation came out, grade seven.
At the end of November, Fang resigned, saying that she did not want to burden the company and wanted to go home to recuperate. After several unsuccessful attempts to persuade her, I calculated the compensation payable by the company according to the relevant regulations and transferred it to her.

I didn’t expect to find a suitable factory after coming for half a month. He passed the interview several times and was asked to go back to prepare the entry documents, but later he always received a phone call and was rejected for various reasons: either the job was full or he was too old to meet the hiring requirements.
In the first few days, Fang would follow Feng around, and then just wait for news in the rented room. Her foot injury has not yet recovered, walking a bumpy, easy to see.
