The Case against Meng Wanzhou remains unresolved but there are new developments

Lawyers for Meng Wanzhou, huawei‘s chief financial officer, have continued to push for an end to the extradition process, arguing that her alleged violations have “no real connection” to the US, according to Canadian court documents. Huawei lawyers also submitted seven statements to support their arguments from legal experts, including a former U.S. ambassador and international law professors in California and the Netherlands. Lawyers for the Canadian government are expected to submit their submissions in the coming weeks. According to court procedures, Ms. Meng will appear in court on Dec. 23 to attend a management meeting of the case. The Canadian Prime Minister Justin Trudeau denied that the families of the two Canadians would be able to receive their release before the New Year.

According to court documents released on Friday, Lawyer Meng Wanzhou, Huawei’s chief financial officer, said her actions had “no real connection” to the United States, Reuters reported. Ms. Meng’s lawyers wrote that the United States’ claim to have jurisdiction over Ms. Meng’s actions was “based solely on non-U.S. business transactions between non-U.S. companies using non-U.S. banks… None of [Ms. Meng’s] alleged acts occurred in whole or in part in the United States and had no impact in the United States.”

International law, they added, “does not allow a State to criminalize the act of a non-citizen outside its territory on the basis of a statement made to another non-citizen with no material or real connection to that state”.

Huawei lawyers also submitted seven statements to support their arguments from several legal experts, including a former U.S. ambassador and international law professors in California and the Netherlands, the report said.

The message gave no details of the names of the authors of the testimony.

Lawyers for the Canadian government are expected to submit their submissions in the coming weeks. Canada’s Justice Department did not immediately respond to a request for comment.

Meng is scheduled to attend a case management meeting in court on Dec 23. The case is expected to be concluded in May 2021.

China has hurt its own interests and alienated other countries by arresting two Canadians nearly two years after Canada arrested a Chinese business executive on a U.S. warrant, Canadian Prime Minister Justin Trudeau said Friday. “What China is doing and the way it is doing it is not helping to improve its relations with any country in the world, it is actually hurting its own interests,” Trudeau said at a news conference, adding that he would continue his efforts to secure the release of the Two Canadians.

Earlier this month, Reuters reported that U.S. prosecutors were discussing a deal with a team of lawyers representing Huawei chief Financial Officer Meng Wanzhou to resolve criminal charges against her. In an interview with Global News earlier last week, Trudeau was asked if he thought the families of the Two Canadians would receive good News before the New Year. “I certainly hope so,” Trudeau replied.

Asked on Friday to be clear, Mr. Trudeau appeared to play down any immediate possibility of an agreement that could lead to the release of the two men. “I still want good news [about their release], whether it’s an hour from now, a day from now, a week from now, a month from now,” Mr. Trudeau said.
