Congressman: We Need Federal Law to Protect Election Integrity

Texas Republican U.S. Rep. Louie Gohmert, an attorney, said Dec. 11 that we need a federal law to protect the integrity of elections and that Congress should act immediately in the face of obvious fraud.

In an op-ed on Newsmax, Gohmert referred to the decision by the Pennsylvania State Board of Elections and the Supreme Court to delay the mailing of ballots by three days as a violation of the Constitution and state election laws.

“The most obvious point is that state election officials and judges do not have the authority to change the law.” He said Article 1, Section 4, Clause 1 of the U.S. Constitution states that the time, place and manner of election of members of the House and Senate of each state shall be determined by the respective state legislatures.

Gohmert had proposed H.R. 8189 in September to amend the Help America Vote Act (HAVA), passed in 2002, to require that all but absentee ballots received after Election Day be considered invalid in compliance with the Military and Overseas Citizens Absentee Voting Act.

“(Election fraud) has been a violation of legitimate voters, and even though we will inevitably start a legal battle, Congress needs to act – to immediately enforce H.R. 8189 and stop the behavior that undermines the Constitution.” In the article, Gohmert said, “So by law, ballots received after 8 p.m. on Election Day are illegal under the U.S. Constitution.”

The above-mentioned illegal changes to Pennsylvania’s election laws have been seen in several swing states. Gohmert supports Texas in its lawsuit against the four swing states before the U.S. Supreme Court, and has cosigned with more than one hundred and twenty other legislators.

The key issue Texas alleges is that four swing states violated the Constitution by changing election rules: Pennsylvania, Wisconsin, Georgia and Michigan. The Texas attorney general asked the Supreme Court to issue a temporary injunction against the four defendant states to prevent the Electoral College from certifying election results or to allow the Legislature to re-elect electors.

The U.S. Supreme Court dismissed the Texas lawsuit on Dec. 11, stating that “no other state’s practices in the election process have been shown to be related to interests within the jurisdiction of Texas. All other pending motions are also denied.”

In the article, Gohmert said, “Without the federal ban, it is clear that politicians and corrupt state officials would have shamelessly overridden the people and illegally allowed fraudulent ballots to be counted.” “The failure of Congress to act has led to a situation in which the integrity of elections is already in great peril.”

“Americans and people around the world are waiting to see what happens. If Congress does not act to protect the legitimacy of the American people’s vote, free America will be gone for good.” Gohmert said.

Currently, President Trump’s legal team has filed numerous lawsuits in courts at the state and federal level, while a third-party attorney, former federal prosecutor Sidney Powell, is also pursuing judicial proceedings.
