General Election Update 12.9: Congressional Committee Denies Biden’s Election

After the U.S. state of Texas stonewalled the U.S. Supreme Court by filing a lawsuit claiming unconstitutional elections in Georgia, Michigan, Pennsylvania and Wisconsin, more states have expressed support and the Supreme Court has accepted the Texas case. The balance is now tilting in President Trump’s favor.

The attorneys general of Arkansas, Alabama, Missouri and Louisiana have issued statements supporting the Texas lawsuit before the Supreme Court to preserve the integrity of the 2020 election.

On Tuesday, the Joint Congressional Inaugural Committee rejected a bill to prepare for Biden’s inauguration in January, voting 3-3.

Democrats on the committee had proposed that Congress inaugurate the party’s presidential candidate, Joe Biden, on Jan. 20, 2021, but the Republican Party said that election-related litigation is ongoing in several states and that President Donald Trump has refused to recognize the fraudulent election results. Since the commission does not recognize Biden as president-elect, arrangements for the inauguration cannot be initiated.

Trump’s legal team officially released a statement saying that December 8, the date known as “Safe Harbor,” is not the final deadline for determining the election results. In fact, the actual date “of ultimate significance” is January 6 of next year, when Congress counts the votes of delegates from each state.

According to two senior U.S. law professors, the 12th Amendment to the U.S. Constitution could authorize Vice President Mike Pence to reject the disputed electoral votes, paving the way for the U.S. House of Representatives to re-elect the president.

In other key states, Michigan lawmakers warned Dominion that subpoenas would be issued for failure to testify; a New York judge ordered the 22nd District Board of Elections to fix a counting error; a Michigan judge denied Wayne County’s request for an election audit; and several Pennsylvania lawmakers filed petitions seeking to decertify election results.

Texas v. Four Swing States is Unconstitutional Multiple States Support it

Texas filed a lawsuit Tuesday (Dec. 8) with the U.S. Supreme Court challenging the election procedures in Georgia, Michigan, Pennsylvania and Wisconsin as unconstitutional, and now Arkansas, Alabama, Missouri and Louisiana have indicated their support for Texas in filing the lawsuit.

Texas alleges that the four states violated the Constitution, changed election rules, treated voters unequally, and relaxed measures to preserve the integrity of the ballot, triggering major voting irregularities. Texas is asking the Supreme Court to declare the four key states unconstitutional in the 2020 presidential election.

The lawsuit was filed on Dec. 7 and was filed the next day. The lawsuit seeks to prohibit the counting of electoral votes cast in the four states. For defendant states that have appointed electors, it asks the court to order state legislatures to appoint new electors in accordance with the Constitution.

Trump Lawyer: Texas Supreme Court Lawsuit Is “The Ultimate Case”

Texas Attorney General Ken Paxton’s lawsuit before the U.S. Supreme Court is the “be-all, end-all case” in President Trump’s long-running legal battle over the election, according to Trump attorney Jordan Sekulow.

Not only did the Supreme Court consider the lawsuit filed by the state of Texas (Tuesday), they’re now taking the next step,” Sekulow said in an interview with Newsmax TV host Grant Stinchfield on Tuesday.

He said the Supreme Court has given the four battleground states of Pennsylvania, Georgia, Michigan and Wisconsin until 3 p.m. EDT Thursday to “respond affirmatively” to the Texas attorney general’s complaint about election fraud.

Arizona lawmakers push for decertification: Elections need to be fair and transparent

On December 7, hundreds of Arizona legislators and citizens rallied in Phoenix to protest the Governor’s certification of Democratic candidate Biden’s victory in the face of clear evidence of election fraud.

The legislators said they are promoting fair elections through laws and procedures at all levels of the election process, and the most immediate way to do so is to urge the Governor to decertify and conduct a forensic audit of Arizona’s election process.

The legislators said that this is not about Trump alone, and it’s not about who has to win, it’s about whether the election is fair and equitable, and it’s about future generations.

Republican Caucus Files Complaint Demanding Georgia Ensure Legal Compliance in Senate Runoffs

The Republican National Committee (RNC) filed a lawsuit Tuesday (Dec. 8) to ensure “proper compliance” with Georgia’s election laws in advance of the Jan. 5 Senate runoff election, as well as to allow Republican poll watchers access to polling places and to establish more regulations on the use of absentee ballot drop boxes.

The Republican National Committee’s lawsuit, first obtained by Fox News, asks “that two important aspects of the Georgia Election Code be properly enforced. These are the rights of duly appointed poll watchers and the legal safeguards for the use of ‘drop boxes’ as a method of absentee voting.

The Republican National Committee argued that during the November 3 general election and the subsequent recount in Georgia “the party committees’ legal right to appoint poll watchers to oversee the voting process was denied at many polling places and tabulation sites.

Allegations of Election Fraud Surge as Most Republican Lawmakers Remain Silent

As credible allegations of election fraud continue to emerge, most Republican politicians remain on the sidelines, saying only that President Donald Trump deserves the opportunity to defend himself in court.

A review of the Twitter accounts of 196 current members of the House Republican Party reveals that they were united last week in protesting the passage of marijuana legalization. However, few have tweeted about election issues, such as expanding election charges or commenting on recent hearings in key states, suggesting that they are avoiding getting involved in the issue.

However, the attitudes of House members do not seem to match the mood of their constituents. According to a POLITICO/Morning Consult poll released Nov. 9, more than 70 percent of Republican voters do not believe elections are free and fair. In Georgia, more than 90 percent of Trump supporters do not believe in the outcome of the presidential election, according to a Dec. 7 online survey of more than 1,700 subscribers by The Epoch Times.

Trump Calls on Justices and Legislature to Have the Courage to Do the Right Thing

On Tuesday (Dec. 8), President Trump again insisted that he won re-election and called on the Republican-dominated state legislatures and the conservative-majority Supreme Court to have the courage to do the right thing.

At a White House event on the COVID-19 vaccine, Trump said, “Hopefully, the next administration will be a Trump administration, because you can’t steal hundreds of thousands of votes.”

He said, “Let’s see if somebody has the courage, whether it’s a legislator or a legislature or a Supreme Court justice or multiple justices on the Supreme Court, let’s see if they have the courage to do what everybody in this country thinks is right.”

“I received nearly 75 million votes, the highest number of votes for a sitting president in the history of the United States. …… If anyone has the courage, I know whose administration the next one will be,” The president said.

Two weeks after Trump pardoned Flynn, federal judge finally drops charges.

Two weeks after President Donald Trump announced his pardon of former National Security Advisor Michael Flynn, D.C. District Court Judge Emmet Sullivan on Tuesday (Dec. 8) finally dismissed Flynn’s criminal case, ending a three-year legal process.

Flynn was Trump’s first national security adviser, and the Flynn case has taken a number of twists and turns as the Democratic Party launched the Russia investigation that has lasted more than three years since Trump took office.

The investigation, which began with an FBI investigation into “collusion” between the Trump campaign and the Russian government during the 2016 election, has been proven false. Many Trump supporters see Flynn’s retirement as a victim of political retaliation by the Obama administration.

Flynn’s attorney, Sidney Powell, and members of the conservative media have accused the FBI of trapping Flynn and using his case as a basis to further expand the scope of the Russiagate investigation.

Pennsylvania GOP lawmakers sue to block certification of election results, Supreme Court denies appeal

The U.S. Supreme Court on Tuesday (Dec. 8) denied an emergency injunction sought by Pennsylvania’s Republican legislators and congressional candidates to prevent certification of the state’s election results. In the ruling, the plaintiffs sought to prevent the state government from certifying the election results, and the federal Supreme Court denied their appeal.

The lawsuit revolved around a Pennsylvania bill that repealed the requirement that “there must be a reason why a person cannot vote in person in order to vote by mail,” significantly expanding the scope of who can vote by mail. The plaintiffs argue that the implementation of the bill is illegal and in conflict with the state’s constitution.

Earlier Tuesday, election lawyers representing the administration of Democratic Gov. Tom Wolf urged the Supreme Court to dismiss the lawsuit. They argued that it could set a precedent for judicial invalidation of presidential elections. But officials in the defendant state disputed the claims in the lawsuit.
