The Hong Kong Democratic Party held a press conference to announce that Lam Cheuk Ting dropped his legal action against the 721 incident.

Former lawmaker Lam Cheuk-ting of the Hong Kong Democratic Party, who is in custody, announced on the 5th that he will not file a civil suit against the police force’s “first brother”, Commissioner of Police Tang Ping-keung, over the “Yuen Long 7.21 white man attack”. His legal representative, Albert Ho, said that the plaintiff turned into the defendant, Lam Cheuk Ting has been exhausted, hoping to free up resources to help more people in need.

Lam’s legal representative, Albert Ho, Democratic Party Central Committee member Chuang Wing-fai and several injured victims of the 7.21 incident held a press conference on Wednesday (May 5).

Zhuang Ronghui, one of the plaintiffs in the 7.21 case, quoted Lam as saying that he had consulted legal advice and the wishes of the other eight plaintiffs, and had also considered the recent political and rule of law situation in Hong Kong, which made it difficult to cope with the lengthy litigation; he also hoped to free up resources for the “612 Humanitarian Support Fund”, which provides support for litigation costs, to help more Hong Kong people in need. Lam Cheuk Ting believes that the right and wrong of 7.21, justice is in the hearts of the people, will certainly be recorded in the history of Hong Kong. He will stand firm and protect the historical facts of 7.21. He will defend the case of the alleged 7.21 riot and the disclosure of the ICAC’s 7.21 investigation to the end.”

As a member of the legal team, the former chairman of the Democratic Party, Mr. Albert Ho, said the team has three barristers, the case has a reasonable chance of winning, but on behalf of the Police Department, the Department of Justice “with a flood of heavy forces”, hiring senior barristers to sit: “the other side used more than a year to complete the 100-page statement of defence “, and repeatedly proposed to remove the lawsuit, the judicial process is complicated, is expected to be scheduled at least more than 1 year after processing. If you lose the lawsuit must compensate a large amount of litigation costs, the cost of millions of dollars. And according to the current progress of at least two years before the trial may be held.”

Albert Ho felt very sorry for the withdrawal of charges, but Lam Cheuk Ting has been exhausted, so support his decision: “This case involves the Commissioner of Police, involving the face of the Government, but also highly politicized. The government is exhausted, not just this case, such as 8.18 (illegal assembly case) have to hire (British Queen’s Counsel) David Perry, many cases have hired a senior barrister, and it does not matter if you lose, you can have money to pay, and no one is accountable. dQ (disqualification) cases, such as the Zhou Ting case, the government lost to pay for legal fees, will say sorry? No, it will not. It (the government) will certainly use all the advantages of those in power to oppress.”

Mr. Albert Ho also stressed that the original intention of the lawsuit is not only to seek justice for the victims of the 7.21 attack, but more importantly, to use it to request the police to disclose more information on that day to restore the truth of the incident: “Why did the police not see anyone? Why didn’t they accept the report? Why did the police run away even though they were beaten? Why did (the police) tap people on the shoulder? I believe there is still a lot of information that has not been taken out. But unexpectedly Lin Zhuo Ting in the incident turned ‘plaintiff into defendant’, and now trapped in prison, Lin Zhuo Ting think ‘this way to fight too expensive, the loss of confidence in judicial justice, heart exhausted’.”

Albert Ho said he clearly understood Lin’s character and would not be under any pressure to withdraw the charges, stressing that Lin was not under any political pressure.

Chuang Wing-fai revealed that he would visit Lam Cheuk-tin every week. Even though he has been remanded for many hours, Lam Cheuk-tin’s spirit is still not bad, but a number of cases do bring pressure to him, and the Democratic Party will give him support.

The Yuen Long 7.21 attack refers to the violent attack that occurred in Yuen Long District, New Territories, Hong Kong during the anti-sending period, i.e. the night of July 21, 2019 and the early morning of the following day. In the incident, a large number of people wearing white shirts and with backgrounds in rural affairs and triad societies attacked passers-by and train passengers indiscriminately with weapons at the Chicken Tei and MTR Yuen Long stations in a premeditated manner, leaving many people bleeding. At least 45 people were injured in the incident, including pregnant women, with one person in critical condition and five people seriously injured.

Evidence after the incident shows that the Hong Kong Police Force in the incident to cover up or even assist the attack, including the police refused to come to the scene to stop the attack after the public reported the incident; after the incident and claimed that they did not see the white shirts gathered in the village of Nanbian Wai people armed; that night into the village investigation also no one was arrested, etc.. There are questions about the police’s knowledge of the attack on the village and triad forces and their deliberate connivance, and there is public opinion that the incident involved “police and triad collusion”, so the incident is said to involve official support of state terrorism. Lam Cheuk Ting was an eyewitness and victim of the incident.
