“Mississippi families and businesses deserve financial compensation because of the malicious and dangerous (spreading of the epidemic) actions of the Chinese (Communist Party of China),” Mississippi Attorney General Lynn Fitch said in a statement this week. “The lawsuit is currently in the judicial process and we look forward to justice for the people of Mississippi.”
Through Fitch’s words, many people have learned that lawsuits related to holding the Chinese Communist Party accountable for spreading the outbreak are currently underway in Mississippi. Naturally, the prosecution is supposed to be American, so who are the defendants? Local Mississippi media outlet WLBT reported that the Southern District Court of Mississippi issued subpoenas to the People’s Republic of China, the Communist Party of China, the Communist Party’s National Health Commission, the Communist Party’s Ministry of Emergency Management, the Communist Party’s Ministry of Civil Affairs, the Hubei Provincial Government, the Wuhan Municipal Government, and the Wuhan Institute of Virus Research and the Chinese Academy of Sciences on December 9 of last year. The reason for suing the CCP is to circumvent the restrictions in the Foreign Sovereign Immunities Act (FSIA). This is because the FSIA restricts Americans from suing foreign governments, but if they sue the CCP, which controls the government, they are not hindered by the FSIA.
The first thing that needs to be confirmed is whether the above defendants have been served with subpoenas. I presume that for the CCP and the CPC the subpoenas should be sent to Zhongnanhai or the highest level of the CCP in Beijing, while others are sent directly to the head of the department. Regarding the method of service, it is likely that the U.S. District Court served the legal pleadings on the above defendants via FedEx, just as the pleadings against Jiang Zemin were sent to Zhongnanhai in 2002, and it is also very likely that some people will receive the letters from overseas with a broad stroke of the pen.
Under U.S. law, these entities are supposed to have 21 days to respond after receiving a subpoena, and the reply brief can deny in whole, deny in part, admit in whole, admit in part, or counterclaim the facts or grounds set forth in the complaint. If no response is made, the district court will be able to proceed to trial by default. Now that nearly five months have passed since the summons was issued, the said defendant has apparently not given a response to the U.S. court, because if there was a response, the U.S. court would have heard about it.
Zhongnanhai is afraid to respond to the lawsuit because it is afraid that the Communist Party’s top brass knows that the Wuhan Institute of Virus Research and the Chinese Communist Party are responsible for the current global epidemic that is getting worse and killing millions of people. As more and more evidence emerges, and as the Chinese Communist Party’s claims that the virus came from nature are disproven, there are calls for the Chinese Communist Party to be held accountable, with the United States, the United Kingdom, France, Germany, Australia, Canada, Sweden, Italy, Spain and Brazil among the countries that have formed a consensus to hold the Chinese Communist Party accountable.
Among these countries, the United States is the first to demand that the CCP needs to be held accountable, and at the presidential level. For example, last May, President Trump said, “China [the Chinese Communist Party] should be held accountable for what they’ve done. They have hurt the world very, very badly. In July, at a U.S. Independence Day celebration, Trump again said that China’s (CCP) secrecy, deception and cover-up of the outbreak allowed the virus to spread to 189 countries around the world, and that China (CCP) must take full responsibility.
In August, in a new policy platform released by the Trump camp, Trump made it clear that he would “hold the Chinese Communist Party fully responsible for the spread of the virus around the world” during his second term. “It came from Wuhan, spread around the world and caused a huge disaster for the United States.
Undoubtedly, Trump is so sure that he must have solid evidence. As U.S. Director of National Intelligence Ratcliffe, who controls the powerful U.S. intelligence network, said in an August 30 interview with Fox News’ Maria program, “We have a high degree of certainty to show that the virus originated in Wuhan, China.”
In January, as Beijing authorities finally agreed to send WHO experts into Wuhan to verify the origin of the virus, the State Department released a fact-checking report on the actions of the Wuhan Institute of Virus Research, focusing on the institute, presenting evidence-based findings and emphasizing the importance of transparency by the Communist authorities.
The report first establishes that the virus came from China and that the CCP lied to the world about the virus and the outbreak.
Second, the report again provides supporting evidence that the CCP virus came from its laboratories by analyzing the research projects of the Wuhan Institute of Virus Research. The report states that since at least 2016, Wuhan Institute of Virus researchers conducted experiments involving RaTG13 and showed no signs of stopping before the COVID-19 outbreak; RaTG13 is the bat coronavirus that the Institute identified in January 2020 as the closest to SARS-CoV-2 (96.2% similar). This is certainly implying that the virus has the ability to make viruses.
Third, the report states that the Wuhan Virus Institute is engaged in covert military activities, implying that Beijing has violated the BWC.
In early April, senior Republican U.S. Rep. Jim Banks (R-OH) called on the Biden administration to take action to hold the Chinese Communist Party accountable for the virus epidemic, demand huge economic losses, and take it to the International Court of Justice in The Hague.
Dr. Lawrence Serling, a member of the U.S. Citizens Commission on National Security and a former 29-year veteran of the U.S. Army, has been speaking out frequently recently, and on April 29, he tweeted clearly: The final hard evidence: there is no doubt that COVID-19 is a Chinese Communist virus created by a Chinese Communist laboratory. Communist scientists have been using animal models to “pass on” genetically modified viruses to make them more deadly since 2005.
Dr. Serling’s certainty is also based on hard evidence, such as the fact that the animal models used by the CCP scientists for their experiments came from a U.S. company called Jackson Laboratory, and that the purchaser left enough information.
At the same time as the U.S. official determination that the virus came from Wuhan Laboratory, U.S. private organizations and individuals have launched lawsuits against the Chinese Communist government. It is reported that at least seven individual lawsuits against the Chinese Communist government were launched in Florida, Texas, Nevada and California last March alone. Missouri was the first state to file a lawsuit against the Chinese Communist Party last April, seeking liability for the global spread of the epidemic and damages for the “enormous loss of life, human suffering and economic disruption” caused by the virus, and the lawsuit is currently underway. Mississippi is a close second.
In the face of the U.S. and many more countries’ actions to pursue responsibility, Beijing has suddenly turned deaf and dumb, not daring to tell the truth to its people. It is important to know that while the Chinese Communist government has diplomatic immunity, the National Health Commission, the Ministry of Emergency Management, the Ministry of Civil Affairs, the Hubei Provincial Government, the Wuhan Municipal Government, and the Wuhan Institute of Virus Research, which are being sued, do not enjoy diplomatic immunity. If the U.S. court decides in absentia that these defendants are also liable and even compensated, the CCP will be in big trouble, and its overseas assets will most likely be frozen. Such an outcome is what the CCP fears most.
Obviously, by now, Zhongnanhai has clearly understood that the claim that the virus came from nature is no longer tenable, and the plan to use the WHO to stand up for itself has also failed, because Western governments do not approve of the WHO investigation report. Next, will Zhongnanhai introduce new scapegoats in order to shake off the blame? For example, virus scientists working for the CCP, or hostile forces within the CCP, and so on. But if the pot is not successfully shaken off, the consequences are unpredictable.
