The state of Texas recently took the federal government to court over the Biden administration’s illegal immigration policy, and former U.S. President Donald Trump’s (Trump) immigration adviser Stephen Miller and the legal team he led joined the case. They argued that the White House violated CDC Order 42 during the outbreak, and that the policy of releasing large numbers of illegal immigrants violated U.S. law.
The Texas Department of Justice, led by Texas Attorney General Ken Paxton, took the Biden administration to court for violating U.S. federal law with its executive order on immigration that allowed illegal immigrants to enter the United States without being tested for the Chinese Communist virus, according to the Epoch Times website. Trump’s former immigration advisor, Miller, is leading the “America First Legal Team” that is providing legal advice on the case.
In an interview with Fox News’ Sean Hannity on Friday, April 23, Miller said that the Biden administration’s “catch-and-release” policy for illegal immigrants during the epidemic released a large number of illegal immigrants. In particular, Biden’s policy of allowing illegal immigrants who are positive for the Chinese Communist virus to enter the United States is illegal.
Shortly after Biden entered the White House in January, he halted the Trump-era policy of deporting all illegal immigrant children without adult supervision. This was in violation of the CDC’s Emergency Order No. 42. Under that emergency order, all illegal immigrants who entered the U.S. illegally from Mexico should be sent back to their own home countries because of the outbreak.
The plaintiff, the State of Texas, said the Biden administration unlawfully failed to enforce the CDC’s emergency order without providing proper justification.
The Texas government expects the judge to rule that Biden’s executive order is illegal and that Biden must enforce the CDC’s Rule 42, which requires deportation of most illegal immigrants on the grounds that the outbreak is still ongoing.
Biden is violating bills that Congress has approved over the past several decades,” Miller said. And more importantly, by refusing to stand firm on our laws, Biden is violating our Constitution and his obligation to faithfully enforce the laws of this country. The courts can and should hold him accountable to end this lawlessness and require him to strengthen our border management.”
White House spokeswoman Jen Psaki said April 23 that the Biden administration partially implemented the CDC’s Section 42 order. “Because it’s still during a global epidemic,” she said.
