The picture is a street scene in Changsha City
The mother of a woman surnamed Shen in Shaoyang, Hunan province, reportedly bought a property in Changsha in 2016 and registered it under her daughter’s name. after 2017, the family did not bother with the house, but the relevant deeds were all intact and collected. Recently, the Shen woman wanted to sell the house, so she came to the door to see the condition of the house. To her surprise, she arrived to find that the house had been partitioned into multiple small suites and had been rented out to tenants. It was only later discovered that the person who rented out her house was the previous owner of the house, Mr. Liu, and the act of renting out the house has been up to three years.
The woman said that from 2018 to now, no one has ever called her to tell her about the matter, and she has not received the rent, only to find out that she is now not only unable to rent and sell the house, but also the layout of the house has been greatly changed.
Shen pointed out that Liu Nan’s house was mortgaged because of his debts, and the family spent 800,000 RMB to buy the house and carry out the closing procedures. However, Liu Nan later considered that the price of the house when it was mortgaged was too low and wanted to compensate him, which is why the house was rented out.
In this regard, the lawyer said that if the original owner sublet the house without the consent of the current owner, then the signed lease is invalid and Shen has the right to ask the tenants to leave; another lawyer said that legally speaking, it should be Shen who enjoys the ownership of the rent.
