Former President Donald Trump (Trump) said Monday (April 12) that it would be “ironic” if Democrats filled the Supreme Court, and that politically correct Supreme Court justices are self-defeating.
The current nine Supreme Court justices have repeatedly refused to hear any lawsuits against the 2020 presidential election.
“Our politically correct Supreme Court will get what they deserve – a group of unconstitutionally elected radical leftist Democrats who are destroying our country,” Trump said in a statement Monday.
He said 19 states challenging the results of the November election filed lawsuits with the Supreme Court, but the justices refused to hear the cases.
“If and when this happens, I hope the justices remember this as a day when they didn’t have the courage to do what they should have done for America,” Trump said.
President Biden announced Friday (9) that he is building a commission to study possible changes to the Supreme Court, including adding more justices.
The White House announced that the panel, created by the executive order, will review the length of service and turnover of justices, the membership and size of the court, and the court’s case selection, rules and practices.
The commission will release a report within 180 days of the executive order’s issuance.
Liberals are now stepping up pressure for Clinton appointee Stephen G. Breyer, a liberal justice, to retire so Biden can pick a replacement.
Breyer warned last week against filling the Supreme Court because that would erode the court’s trust and its power to check and balance.
Justices are nominated by the president of the United States and appointed with the consent of the Senate. Justices are appointed for life and can serve for life as long as they are loyal to their office and cannot be removed from office without impeachment by Congress.
In his statement, Trump also said conservatives are “powerless” in the fight because Senate Republican leader Mitch McConnell will not fight it.
“Leaders like McConnell, they can’t fight. He’s not fighting for the presidency, and he’s not going to fight for the Supreme Court.” Trump said.
