The Biden administration’s immigration policy has sparked a backlash from states. Arizona Attorney General Mark Brnovich said Monday (April 12) that the state has renewed its lawsuit against the Biden administration, alleging that its immigration policies and decision to halt border wall construction have brought in an unprecedented number of immigrants and had a “devastating impact” on the state’s environment.
In this lawsuit, we allege that the Biden administration is violating the National Environmental Protection Act (NEPA) and that the left is using it to block highway projects, airport redevelopment and everything else,” Buonovich said on Fox News’ “Fox & Friends. “
This is the third time Arizona has sued the Biden administration for border actions. The suit says the administration stopped building the wall “in violation of NEPA because it allows more and more people to enter the state.” Buonovich said, “This has had a devastating impact on our environment and a population growth, which in turn has all sorts of implications for future development.”
He added that the Biden administration did not conduct an environmental impact study when it came to immigration, which “violates federal environmental law.”
Each migrant who crosses the desert to Arizona is estimated to leave behind at least six to eight pounds of waste, including plastic bags, drug paraphernalia, backpacks and more, according to Bunovich’s analysis.

Buonovich said that because the policy was set by President Joe Biden, “everyone got a pass, and that’s not right.”
He added that other lawsuits have targeted the Biden administration for “encouraging and incentivizing illegal immigration,” but “what we’re saying is that by stopping the wall and reversing the policy (of letting immigrants) stay in Mexico, they are violating the National Environmental Protection Act (NEPA). Biden began his tenure in the White House by issuing an executive order overturning the Donald Trump administration’s Migrant Protection Protocol (MPP) and announcing a halt to the construction of a wall on the U.S.-Mexico border. On the same day, the Department of Homeland Security (DHS) also issued a memo ordering states to suspend deportations of illegal immigrants for 100 days.
Texas led the charge against Biden’s deportation moratorium, and several other states followed suit, including Arizona.
In an interview with Fox News, Texas Attorney General Ken Paxton said Biden’s executive order has effectively sent the message that the U.S. borders are open. That poses a risk to his state.
Buonovich: Immigration crisis may become a real tragedy
Buonovich also told Fox News he was “very disappointed” that Vice President Kamala Harris has not been present in the region or visited the site herself since she was appointed to handle border diplomacy.
He said he has invited her to Arizona, but has not heard back.
In his letter to He said: “Whether we are Democrats or Republicans, everyone knows that the cartels (of the Mexican drug cartels) make money from everyone who crosses the border. We know they are using it now to dramatically increase fentanyl, cocaine, heroin (smuggling).”
“If we don’t do something now, this will become an unquestionable tragedy.” Buonovich told Fox that illegal immigration and drug trafficking, not only affects Arizona, but other U.S. cities.
He added that many immigrants come to the United States because they believe it is a nation of laws, a place where “the rule of law means something, which means we are all treated equally.
But the Biden administration, Buonovich said, “can choose which laws apply to which people, and when the Biden administration can unilaterally rewrite federal laws and federal regulations, they undermine that. People understand it’s not fair, it’s not right,” he said.
He added that the current administration’s policies “are unfair to anyone who follows the rules.
