The leftist activist group Demand Justice launched a new “Breyer Retire” campaign on Friday (9), calling for the immediate resignation of liberal Supreme Court Justice Stephen Breyer. Stephen Breyer to resign immediately because of his opposition to expanding the Supreme Court.

“Demand Justice posted an online petition claiming Breyer should resign immediately and drove a truck with billboards around the U.S. Supreme Court building on Friday.

Biden has said he would appoint the first black woman to the Supreme Court. Radical leftists say Breyer could risk letting the Senate fall into Republican hands until Democrats confirm Biden’s nominee.

Justice Breyer, who was appointed by former President Bill Clinton in 1994, is 82 years old and the oldest Supreme Court justice. He is widely known as one of three liberal Supreme Court justices whom the left wants to retire so that Democratic President Joe Biden can appoint his justices.

Democrats’ concerns about Breyer stem from the late Justice Ruth Bader Ginsburg’s previous refusal to heed calls from liberals and former President Barack Obama to retire, ultimately leading to former President Trump’s appointment of conservative-leaning Justice Amy Coney Barrett after Ginsburg’s death.

Democrats have proposed increasing the number of Supreme Court justices in an effort to weaken conservatives. Speaking at Harvard Law School on Tuesday, Justice Breyer did not hint at the possibility of his retirement, but stressed that expanding the Supreme Court would make the justices more political and erode public confidence in its decisions.

Currently, the U.S. Senate is split 50-50 between Democrats and Republicans, with the only way to break the tie is through the vice president’s vote. That means Republicans could take back control in the event of an unanticipated situation where a Democratic senator opposes or resigns.

“The more the timing of Breyer’s retirement is portrayed as a partisan goal, the less he wants to do it,” Harvard law professor Noah Feldman wrote in a Bloomberg op-ed, “if it is seen as ‘in order to ‘ resign to allow Biden to pick a successor, it would betray Breyer’s own career goal of making decisions based on what is good for the country rather than what is good for a particular party.”

White House press secretary Jen Psaki did not defend Justice Breyer, who is under attack by left-wing groups, on Friday.

CBS White House correspondent Ed O’Keefe asked, “What does the president’s commission to expand the Supreme Court …… president think about calling for Justice Breyer’s resignation?”

Psaki claimed that Biden believes it will be up to Justice Breyer to decide when he will no longer serve as a Supreme Court justice.

Radicals on the left have been urging Biden to nominate a diverse group of justices to the federal court and to push for structural reform of the court. Biden signed an executive order Friday establishing a commission to look specifically at potential Supreme Court reforms.
