Android developed with Oracle software code Supreme Court rules no infringement by Google

The U.S. Supreme Court ruled Monday (5) that Google, a U.S. technology company, did not violate federal copyright law by using software code from another computer technology company, Oracle, to develop the Android operating system widely used in smartphones, ending a 10-year-long copyright lawsuit between the two companies.

The Supreme Court reversed a 6-2 appeals court ruling that Google’s use of Oracle’s software code did not comply with the fair use doctrine under federal copyright law. The Supreme Court judge said that allowing Oracle to enforce its copyright in this case would turn it into a shackle that would stifle the creation of new programs in the future.

The copyright battle between Google and Oracle began in 2010, when Oracle filed a lawsuit against Google in San Francisco federal court, and Google appealed the decision of the Court of Appeals for the Federal Circuit in Washington, D.C., in 2018.
