Recently, dozens of truck drivers in Shanxi in the territory of Gansu was found by the local police “drug driving”, and the driver questioned the police fine is to complete the task of indicators. The picture shows the Shanghai traffic police on duty on July 30, 2019.
Recently, dozens of truck drivers in Shanxi Province were detected by the local police in Gansu Province for “drug driving”, and these drivers have experienced “confiscation of cell phones, handcuffed for a long Time, detained for questioning” and other mandatory measures, and the police claim to admit drug driving The police claimed that admitting to drugged driving “would not affect the license and leave a drug record”. But afterwards the drivers discovered that their ID cards were “tampered with”.
According to Red Star News on March 16, late last year, Mr. Liang of Shanxi, as usual, drove a large truck to transport goods, through Gansu Jiuquan City Guazhou County Liuyuan checkpoint, but was being checked by the police summoned to the office on the road, asked to cooperate with the urine drug-related test, the test results were positive, and finally was qualified as drug driving. Mr. Liang was fined 500 yuan by the police.
“I don’t even touch those things how can I say I’m on drugs? Coffee, tea inside also contains caffeine, I wanted to do a blood test is not allowed, the other side let me take a statement, but also handcuffed, questioned me for 36 hours, and finally I had no choice but to make up the circumstances of their own consumption of sodium amphetamine coffee.” Mr. Liang recalled.
According to Mr. Liang, he has more than 10 years of truck driving experience, sometimes he will encounter methamphetamine or morphine test paper inspection, caffeine testing is the first time he encountered, “before I did those tests are no problem, this time after a positive test I asked to do a second test, blood or hair testing, the other side will not let, and finally they said it would not affect my license, I just said The other side won’t allow me to do a second test, and finally they said it wouldn’t affect my license, so I lied and made up the drug use scenario.”
Afterwards, Mr. Liang found that just at the end of last year, there were 31 other truck drivers in Shanxi who were stopped and tested positive for urine, and they all submitted relevant materials to the court.
Mr. Wang, a truck driver from Linfen, Shanxi, also tested positive for drugs in his urine when he went through Guazhou, Gansu. Mr. Wang said that the route from Shanxi to Xinjiang he will basically run two or three trips a month, generally carrying alumina. Sometimes there will be two or three masters in the fleet, and the two masters who traveled with them that day were positive for urine tests.
According to Mr. Wang, at that time, he was taken to the police station, his cell phone was confiscated and questioned until 12:00 p.m., and finally he made up the circumstances of his drug use. After being fined 500 yuan, he appealed the verdict of the Guazhou County Yuanquan Police Station and applied for an administrative reconsideration to the Guazhou County Public Security Bureau.
Eventually, the Guazhou County Public Security Bureau decided to uphold the administrative penalty imposed by the Yuanquan Police Station. “I am not satisfied with the results of the administrative reconsideration, the police who asked before said that it was only a fine and would not affect our driver’s license and would not have a criminal record, we just made up the drug episode and wanted to get out as soon as possible, but soon after we went back, every time we stayed in a hotel and swiped our ID cards, we were always asked to do a urine test when we crossed the checkpoint, which caused a great impact on our lives , so I will also sue afterwards.” Mr. Wang said.
Also according to Mr. Liang, all 32 of them were caught drug driving when they went through Guazhou, Gansu, from Dec. 1 to 16. “are only tested urine, we confiscated our cell phones and brought to questioning, suspecting that they do so is to complete the task.”
For the specific circumstances of the case, Shanxi driver Mr. Liang’s agent lawyer Jiang Bin believes that similar analogies can be deduced is that drunk driving, after blowing preliminary detection of suspected drunk driving, but also need to be brought back to the public security organs to do further blood tests in order to confirm drunk driving. And this case, the police only by virtue of a urinalysis board shows a positive caffeine, the plaintiff confirmed drug use driving vehicles, does not meet the mandatory police standards and requirements.
