Just hypothetically: what would happen if Jack Ma Jr. were in Canada?

A rather legendary piece of news has been widely circulating on Chinese social media since the yellow calendar New Year of 2021. The one who was called Jack Ma Jr. and whose real name is Fan Xiaoqin, a boy from rural Jiangxi province, born in 2008, was found to look like Jack Ma in his childhood in 2015, and turned to exhibit both the glamorous and flamboyant world and make his presence known in the business propaganda, only to finally return to his hometown and live his old Life during the Chinese New Year in 2021.

This is a family of five with three generations, and it is obvious to anyone who understands: this is a poor family.

They live in Yanhui Village, Yongfeng County, Ji’an, Jiangxi, and the local government has classified them as a poor household for precise poverty alleviation. The whole family is currently enjoying low income subsidies.

Out of curiosity, the Writer asked her social worker friend here who evaluates social welfare applications to ask how the subsidy index is calculated in Toronto for this one case. If the family is in Canada, please read on, it’s this account.

Both Parents are disabled, plus two children, a family of four, and they get over $1,900 in welfare benefits. The two children receive the maximum “milk grant” of $600 per child until they turn 18. This is a tax incentive, and the two children together will receive $1,200. The grandmother, who has a separate social welfare account, receives $1,500 in old age benefits, which exceeds the amount of disability benefits.

So this three-generation family of five receives about four thousand six hundred dollars a month from the government here. All medical treatment expenses for this family are completely free. If they live in a government-provided low-cost rental property, depending on their family situation, they can enjoy a three-bedroom apartment, with rent levied based on one-third of their income. Even with reference to the housing rental market, they can rent a three-bedroom apartment for no more than $2,000. The standard of living provided by the government is that people live a quality, dignified life. So, when it comes to the children’s holidays, the whole family can afford to spend on vacation trips.

Fan Xiaoqin’s younger brother was led out of his poor family’s Home by the cool face of Jack Ma as a child, leaving his family at a young age and entering the world of pomp and circumstance alone, and the title of Little Jack Ma spread farther than his own real name. Some businessmen pack up little Ma Yun with metropolitan clothing, and make up some advertising slogans for little Ma Yun to shout at the various media’s long guns and shouting. From then on, Fan Xiaoqin’s younger brother, cloaked in the title of Little Ma Yun, was pushed off the business scene and involved in the whirlwind of commercial publicity. Probably, Little Ma spent his childhood life from the age of 8 to 12, four years. It is said that when the businessmen took him away from his family, they promised to train him for college; if he failed to go to college, they would help him find a job.

In Canada, it is almost impossible by law to take a child away from his or her parents, even if the parents voluntarily relinquish custody, which rarely happens. This can be interpreted as adoption. Adoption cases are led by the Child Aid Society (CAS) and are only established after a court process. Once the family has relinquished custody of the child, CAS takes over the custody of the child and changes it to the CAS name. Any individual who wishes to apply for adoption or custody must pass the CAS assessment and be confirmed by a court decision before the adoption relationship can be established. Any organization, especially business enterprises, is excluded.

Canadian law strictly prohibits the employment of child labor, and the exploitation of child labor is a felony. In China, young Jack Ma was brought into the commercial and promotional environment by businesses, and the writer has seen his behavior described as such in the press. There is no doubt that this is a crime of child labour and child exploitation on Canadian soil. In Canada, such businesses are not only criminally prosecuted by the state and subject to corporate arrest, but children’s rights organizations can launch civil suits for large fines.

During the Chinese New Year in 2021, Fan Xiaoqin was sent back home to his original living environment. The original promise to “train him for college” was gone; “help him find a job.” That would be years later. Who would have remembered!

This is a civil dispute over the breaking of a contract. A contract can be not only a black and white letter of contract, but also a verbal promise made on oath. Promises made, must be honored, this is the spirit of contract. This dispute over the breach of a verbal agreement is equally actionable under Chinese and Canadian law.

To answer the question here: What if Jack Ma were in Maple Leaf country? The answer is: the saga of Jack Ma Jr. would not have been created here. The first reason is that here, even if the parents have disabilities, the family life is still of quality and dignity, and there is no need to change the life through the method of giving children. The second reason is that the rights and interests of children and adolescents are strictly protected here, and children and adolescents are independent and are the future of society, not subordinate to their parents and families.

The Children’s Aid Society does not have to seek the consent of the parents’ family, and can take over custody from the parents’ family in accordance with the statute by filing a petition with the court, if the court allows them to do so. The third reason is that here, the legal system is equal and the free legal aid scheme protects vulnerable groups from infringement of their legitimate rights.
