The case originated with a man who claimed to be a Chinese Communist Party spy, Wang Liqiang, alleging in a 2019 interview with Australian media that China Innovation Investment was set up under the Chinese Communist Party’s General Staff to “infiltrate Hong Kong‘s financial markets and collect military intelligence” and that China Innovation Investment invested in Taiwan’s media industry so that the Chinese Communist Party could control them and attempt to censor them. The Taiwan Taipei District Court yesterday found that the Xiangxin couple and four others are suspected of violating Article 5-1, Paragraph 1 and Article 2-1, Paragraph 1 of the National Security Law, and the crime involved is a felony with a sentence of five years or more, and there are facts and considerable reasons to believe that there is suspicion of flight, annihilation, forgery, falsification of evidence, collusion with accomplices or witnesses, and after consideration in accordance with the principle of proportionality, it is considered necessary to restrict the exit, so Ruling.

After the “Wang Liqiang spy case” 2019 broke out, Taiwan’s prosecution and investigation unit immediately launched an investigation and found that the two Xiangxin couples were in Taiwan and wanted to leave the country on the evening of November 24, 2019 to return to Hong Kong. The prosecution also found that two of the mansions were rented out to Lin Xu, the founder of Hong Kong-based Wanzhuo Group, and Su Jianfeng, the owner of a Chinese technology company. The prosecution also named the two as defendants in violation of the National Security Law and restricted them from leaving the country for eight months; however, the two claimed they had nothing to do with the espionage case and requested that the restriction be lifted, but the court rejected the request.

According to Taiwan’s new law, if a person considers it necessary to continue the restriction on leaving the country, he or she should apply to the court for an extension before the expiration of the restriction period with reasons, the first Time for 4 months and the second time for no more than 2 months, and the extension should be limited to 2 times.
