Some Democrats have proposed “stuffing” the court by expanding the number of justices and filling the resulting vacancies with left-wing judges. The goal is to eliminate the court’s current nominal 6-3 conservative majority, which former Attorney General Eric Holder and other Democrats claim undermines the court’s “legitimacy.
Biden dodged questions about court stuffing throughout the fall of 2020 until announcing his plans to form a commission to study the issue. As Breitbart News reported in late October, “Biden confirmed to reporters in Chester, Pennsylvania, that he will form a bipartisan commission to study reforms to the judiciary and will report back to him within 180 days of his taking office in January.”
Politico reported Wednesday that the “bipartisan” commission will be chaired by Biden’s former campaign lawyer, Bob Bauer, a career Democratic activist who also worked at Perkins Coie. Perkins Coie was involved in then-candidate Donald Trump‘s Russia “dossier” in 2016, and its election law practice, led by Marc Elias, led Democratic filings throughout the 2020 presidential election and beyond.

The committee includes Cristina Rodríguez, a Yale Law School professor and former deputy assistant attorney general at the Obama Justice Department, who will serve as co-chair along with Bauer. Caroline Fredrickson, former president of the American Constitution Society, and Jack Goldsmith, a professor at Harvard Law School and former assistant attorney general at the Bush Justice Department, will also serve on the committee, people familiar with the matter said.
The Politico website notes that Goldsmith does not support Trump.
