Full text of the U.S. proposal to “designate the Chinese Communist Party as a transnational criminal enterprise”

Senior U.S. Congressman Scott Perry (R-PA), in conjunction with Congressman Tim Burchett (R-UT) and Congressman Scott DesJarlais (D-CA), introduced a bill on October 1, 2020, calling for the designation of the Chinese Communist Party (CCP) as a “transnational criminal enterprise” and for its prosecution and sanction.

The bill states that the CCP knew about the coronavirus in December 2019, but ordered the samples transferred to state institutions or destroyed on January 3, 2020; and that the CCP’s concealment of the outbreak led to a global pandemic of the CCP virus that killed (more than) one million people.

The bill also cites a March 2020 written ruling by the U.K.’s independent People’s Tribunal, which said that the Chinese Communist Party’s forced organ harvesting may be the “worst atrocity ever committed” in the modern world.

In the past 14 years, the international community has released at least eight major investigative reports testifying that the CCP has forcibly harvested the organs of Falun Gong practitioners and other prisoners of conscience.

The following is the Chinese translation of the “Designation of the Chinese Communist Party as a Transnational Criminal Group” bill.

Part I: Short Title.

This bill may be referred to as the “Designation of the Chinese Communist Party as a Transnational Organized Crime Syndicate Act”.

Part II: Discovery.

Congress found the following facts.

(1) The 90 million members of the Communist Party of China (the Act’s acronym: Chinese Communist Party, CCP) are the sole ruling party in China under the leadership of General Secretary Xi Jinping.

(2) On June 30, 2020, China (CCP) passed the draconian “Hong Kong National Security Law” in direct violation of the Sino-British Joint Declaration, giving the ruling CCP sweeping new powers over the semi-autonomous city of Hong Kong.

(3) The “National Security Law” allows mainland Chinese Communist Party officials to operate in Hong Kong and gives Beijing the power to make Hong Kong people obey the Communist Party’s directives.

(4) The health of foreign nationals is threatened under the CCP’s new national security law.

(5) In response to unjust human rights abuses committed by the CCP-led abuse and imprisonment of Uyghurs, Secretary of State Mike Pompeo announced on July 9, 2020, that the Trump Administration will ban the following three prominent CCP officials from entering the United States.

(A) Chen Quanguo, Secretary of the Communist Party Committee of the Northwest Xinjiang Uyghur Autonomous Region and member of the Politburo.

(B) Zhu Hailun, Secretary of the Xinjiang Political and Legal Committee; and

(C) Wang Mingshan, Secretary of the Party Committee of the Xinjiang Public Security Department.

(6) On July 13, 2020, China’s (CCP) Ministry of Foreign Affairs issued a statement to U.S. Senator Ted Cruz of Texas. (7) On September 22, 2020, the House of Representatives passed H.R. 6210, the Uyghur Forced Labor Prevention Act, on a broad bipartisan vote.

(8) Despite China’s (CCP) commitment to recognize all fentanyl products as drugs as of May 1, 2019, China remains the primary source of fentanyl trafficked into the United States last year, according to the 2020 U.S. Drug Enforcement Administration (DEA) intelligence report.

(9) Fentanyl, which is 50 to 100 times more potent than morphine, caused 18,335 American deaths in 2018.

(10) Chinese scientists and authorities knew about the coronavirus as early as December 2019, but were ordered by CCP officials to transfer the samples to state institutions or destroy them on January 3, 2020.

(11) The CCP denied the World Health Organization access to their country and refused repeated offers of assistance from the U.S. Centers for Disease Control throughout January 2020.

(12) The Chinese (Communist) government did not acknowledge clear evidence of human-to-human transmission of coronavirus until January 19, 2020.

(13) China (CCP) chose to blockade the city of Wuhan on January 23, 2020, but 5 million people had already left Wuhan before then.

(14) Chinese doctors who attempted to provide transparency regarding the consequences of the SARS-CoV-2 virus were arbitrarily arrested and the whereabouts of several doctors are unknown.

(15) The Chinese (Communist) government has imposed a travel ban on its own people, but has told other countries, including neighboring countries, that similar restrictions are unnecessary.

(16) More than 200,000 people have died from COVID-19 in the United States and about 980,000 worldwide. (Editor’s note: As of January 11, 2020, more than 370,000 people have died in the U.S. and more than 1.93 million worldwide.)

(17) The Director of the Federal Bureau of Investigation (FBI), Christopher Wray, said that the U.S. government has been working with the FBI to develop and implement a new approach to the problem. Christopher Wray (Christopher Wray)

recently said, “The threat of counterintelligence and economic espionage from China (Communist Party of China) is the greatest long-term threat to our nation’s information and intellectual property, and to our economic vitality. “

(18) Director (FBI) Ray clearly identified the source of this economic espionage, malicious foreign influence, and threat: “When I talk about the threat from China, I mean the Chinese government and the Chinese Communist Party.”

(19) According to a recent 2017 report by the U.S. Commission on Intellectual Property Theft, China (the Chinese Communist Party) is responsible for coordinating a massive intellectual property theft campaign that steals anywhere from $250 million to $600 million annually from the United States.

(20) The IP Commission’s estimates do not include “the full cost of patent infringement – an area that desperately needs more study.”

(21) The U.S. Trade Representative has confirmed the findings of the 2017 IP Commission report.

(22) The IP Commission (The IP Commission) found that forced technology transfers, cost the U.S. economy between $180 million and $540 million per year; of these losses, The IP Commission also found that the Chinese Communist Party accounted for the largest share of these thefts.

(23) According to FBI Director Wray, the extent of CCP crimes is so widespread and massive that “the FBI initiates a counterintelligence case related to China (CCP) about every 10 hours, and almost half of the nearly 5,000 ongoing FBI counterintelligence cases nationwide are currently related to China (CCP).”

(24) In a March 2020 report, the non-profit investigative organization China Tribuna (based in London, England) detailed that the Communist Party’s forced organ harvesting of innocent victims may be one of the “worst atrocities committed” in the modern world.

(25) The 2019 China Report of the U.S. Congressional and Executive Commission on China (CECC) states that the CCP has failed to protect the human rights of its citizens.” [The 2019 report] found that as the Chinese [Communist Party] government and Party increasingly use regulations and laws to exert social and political control, the human rights situation has deteriorated and the rule of law continues to deteriorate …… targeting rights advocates, religious believers, and minority groups, while abuses of criminal law and police power continue unabated, and abuses of reporting of these abuses is also increasingly restricted.”

(26) The CCP’s criminal negligence following the discovery of the coronavirus led to the loss of millions of American jobs and the outbreak of a global economic recession.

Part III: Designation of the CCP.

(a)Transnational Organized Crime Group- On the date of this Act, the Attorney General shall define the CCP as a transnational organized crime group.

(b)International Criminal Organization Target List- On the date of implementation of this Act, the Director of the Federal Bureau of Investigation shall designate the CPC as the top international criminal organization for the Department of Justice.

  1. Part IV: Amendments to (Legal Provisions) for Prosecution of the Chinese Communist Party.

(a) In General- Chapter 96 of title 18, United States Code, is amended by (proposing) adding at the end the following.

Ҥ1969. Certain provisions applicable to prosecution of the Chinese Communist Party.

“(a) In general- Not later than 90 days after the implementation of the ‘Designation of the Chinese Communist Party as a Transnational Organized Crime Group Act’, the Attorney General shall submit a report to the Committee on Foreign Affairs of the House of Representatives, the Permanent Select Committee on Intelligence, the Committee on Foreign Relations of the Senate, and the Select Committee on Intelligence, including

“(1) the rationale for designating the Chinese Communist Party as a transnational organized criminal group under part III of the ‘Designation of the Chinese Communist Party as a Transnational Organized Criminal Group Act

“(2) the number and scope of activities (as defined in section 1961(1)) engaged in, facilitated, or unlawful by the CCP; and

“(3) the recommendation of penalties under section 1963 or 1964 for any violation of section 1962.

“(b)Limitation on Proceedings- No limitation on proceedings shall preclude prosecution for an offense for which the CPC was involved in unlawful activity (as defined in section 1961(1)) more than 15 years after the date of such offense.

“(c)LEGAL LIABILITY- The regulations providing protection against legal liability to any agency or instrumentality of a foreign country under chapter 97 of title 28, United States Code, or any other law, shall not apply to the CCP during an investigation of unlawful activity (as defined in section 1961(1)) or if the CCP is alleged to have engaged in unlawful activity (as defined in section 1961(1)).

(b) INSTRUMENTAL AMENDMENTS- Chapter 96 of title 18, United States Code, is amended by adding at the end of the table of contents the following.

“Section 1969 . Certain provisions applicable to prosecution of the Chinese Communist Party.”
