Andrew McCarthy, a senior fellow at the National Review and a former prosecutor, said in an article that “this is a dark day in American history, and no one is feeling it more strongly than Mike Pence.”
McCarthy said, “Even though the electoral votes are being counted at the end of the day and Biden has been confirmed as the next president, both sides of the political spectrum are calling for Pence to invoke the 25th Amendment to the Constitution to oust Trump with less than two weeks left in office before (Biden takes office). But make no mistake, that would be an unconstitutional act.”
McCarthy noted that the 25th Amendment is not a substitute for impeachment, which is a necessary procedure used to deal with a specific dire situation, namely when a sitting president is unable to perform his presidential duties due to some medical emergency.
“The amendment is intended to deal with situations like the stroke of former President Woodrow Wilson, or the assassination of a president, which, as our history shows, can sometimes be when (a president) needs life-threatening emergency surgery or is unfortunately found to have certain illnesses and the president has a period of time before he dies. term of office.”
McCarthy explained, “The amendment does not apply to situations in which the president is unfit to serve because of (the president’s) character, or because he or she has been charged with political crimes that could rise to the level of felonies and misdemeanors.”
Pelosi told the media at a press conference in Washington on the 7th that “Congress may be prepared to move forward with impeachment if the vice president and the cabinet do not act.” She hoped Pence would be able to remove Trump from office on the 7th via the 25th Amendment. But neither the White House nor the vice president’s office has commented on this.
There are now just 12 days left before Trump’s first term expires. The Democratic presidential nominee is preparing to be sworn in on Jan. 20.
