U.S. media Newsmax reported Tuesday (Dec. 29) that on the same day Republican U.S. Rep. Louie Gohmert of Texas filed a lawsuit against Vice President Mike Pence, lawyers from both sides had a conference call before suing Pence, however, the two sides failed to agree on how to formally accept the Electoral College,.

Describing the failed talks in a filing Tuesday (Dec. 29) in federal court in Tyler, Texas, U.S. Rep. Louis Gohmert (D-N.Y.) argued that Pence has the right to reject the swing state’s Democratic Electoral College and allow President Trump to succeed him. Gohmert is seeking a court order requiring the vice president’s attorney’s office and the U.S. Justice Department to respond to the lawsuit by Wednesday night (Dec. 30).

Before the suit was filed, Gohmert’s attorneys outlined Rep. Gohmert’s legal arguments in an email to the vice president’s attorney’s office and eventually held a meeting with Pence’s lawyers by phone, according to documents sent to the court on Tuesday.

U.S. media outlet Gateway Pundit commented that apparently Mike Pence is no longer interested in politics. Trump voters will never forget Pence’s betrayal of the country and of the president.

The U.S. House and Senate will hold a joint session on Jan. 6 to officially open and count the votes cast in each state. The vice president has the constitutional responsibility of presiding over the Senate, which traditionally includes overseeing the official acceptance of the Electoral College vote.

According to Rep. Gohmert, “Pence should be able to select Arizona, Georgia, Michigan, Pennsylvania and Wisconsin, with Electoral College elections by Republican-led state legislatures, “because this is not a routine situation, and there is overwhelming evidence of election fraud and other during and after presidential elections in those states violations.”

Rep. Gohmert’s filing with the court Tuesday also asked Trump-appointed U.S. District Court Judge Jeremy Kernodle to expedite the case and issue a ruling by Jan. 4 to allow time for an expedited appeal.

Rep. Gohmert also said he failed to convince Pence’s attorneys to expedite the proceedings and allow the congressman to formally file the lawsuit via email.

Rep. Gohmert v. Pence is the latest in a series of grievance-filled election lawsuits that have been filed in courts large and small across the United States following the Nov. 3 presidential election, all of which contain overwhelming evidence that Democrats committed rampant voter fraud in the election, resulting in 7 million more votes for Biden than for Trump. But almost all of the lawsuits were excluded by courts at all levels on the grounds either that they did not have the proper jurisdiction to rule or that there was insufficient evidence. Even though many of the judges on these courts were appointed by President Trump, such a sobering situation still occurred.
