A court in Yantian, Shenzhen, handed down sentences Tuesday (29) after 12 Hong Kong youths were intercepted and detained for more than four months by Chinese public security officials on their way to Taiwan. Deng Kaiyan was sentenced to three years, Qiao Yingyu to two years and Li Yuxuan and others to seven months. In addition, two juveniles, Liao Ziwen and Huang Linfu, were handed over by Shenzhen police to Hong Kong police at about 11 a.m. the same day.
The Shenzhen Yantian District Court handed down its verdict on the “12 Hong Kong people case” at 10:30 a.m. Tuesday, sentencing Deng Kaiyan to three years in prison and a fine of 20,000 yuan for “organizing others to cross the border” and Qiao Yingyu to two years in prison and a fine of 15,000 yuan. The court also sentenced Zheng Zihao, Yan Wenqian, Zhang Mingyu, Zhang Junfu, Huang Weiran, Li Zixian, Li Yuxuan and Guo Zilin to seven months in prison and a fine of 10,000 yuan for the crime of border-crossing. The court said that all 10 people confessed truthfully to the crime and pleaded guilty to the penalty.
The court noted that in August 2020, Deng Kai-yin and Qiao Ying-yu planned and organized the smuggling of people from Hong Kong to Taiwan according to the arrangement of others, and Deng Kai-yin purchased the smuggling vessel. At 8:00 p.m., the smuggling vessel was seized by the Shenzhen Marine Police Bureau in waters under the jurisdiction of Guangdong Province, and Deng Kairan and the others were detained and approved for arrest by the procuratorial authorities on September 30 of the same year.
The court held that Deng Kai Ran and Qiao Yingyu organized others to smuggle across the border in large numbers, which constituted the crime of organizing others to smuggle across the border, while the eight people prosecuted violated border management regulations and smuggled across the border in a group, which constituted a serious crime of smuggling across the border. Deng Kai Ran and Qiao Ying Yu were organized by others to commit the crime and were accomplices in the joint crime, so they could be punished at a reduced level according to the law, while the other eight people could be punished at a lighter level according to the law.
The court also revealed that in addition to Hong Kong and Shenzhen deputies to the National People’s Congress, CPPCC members, journalists, as in the previous trial, there are “family members” of the defendants to observe the public sentencing of the case.

As for the remaining two minors, Huang Linfu and Liao Ziwen, the court notice also said that the decision not to prosecute for the crime of border-crossing was made for the minor Huang Linfu, who voluntarily pleaded guilty to the crime and Liao Ziwen, who was underage at the time of the crime. Shenzhen Public Security Bureau Yantian Branch subsequently issued another notice that Huang Linfu and Liao Ziwen have been deported today.
The news said that two of the underage Hong Kong people who have been detained in Shenzhen in connection with the smuggling case were handed over to the Hong Kong police at 11 a.m. Hong Kong police met with the media at 12 noon to explain the receipt of the two suspects returned by mainland law enforcement agencies, attended by the Commercial Crime Bureau Acting Chief Superintendent Cheng Lai-kei, and the West Kowloon Regional Crime Division Senior Superintendent Tsang Chung-bin.
