Why is Trump confident of winning the election? Federal law says so
According to federal law, a Jan. 6 congressional challenge to the electoral votes by Republican lawmakers could help Trump defeat Biden, The Hill reported.
George M. Jeremy Mayer, an associate professor of policy and politics at Mason University’s Schar School, recently wrote in The Hill that although the controlling federal law, the Election Count Act (ECA), is more than 100 years old, it has been invisible because it has never been fully used. However, the ECA will come into play this year in a joint session of the two chambers.
Under the ECA, when a member of the House or Senate challenges a state’s electoral vote results, each chamber will debate the challenge for two hours. Therefore, many people analyze that even if Republican lawmakers challenge the Electoral College voting results in all six swing states, the entire debate will only last 12 hours. And because House Democrats are in the majority and the Senate has some Republicans who do not support Trump, the end result is that the electoral college results in these swing states will still be in effect, thus declaring Biden the winner.
However, after carefully studying the ECA, Meyer talked about how, under the law, Republican lawmakers in both chambers could challenge each elector vote in each state separately, not just the overall Electoral College vote in each state. In addition to swing states, they can also challenge the electoral vote results in all other states, even blue states. This would delay the congressional debate period until Jan. 18.
Meyer said that if the Senate President and Vice President Mike Pence does not announce the results of the electoral college in each state by Jan. 18, then a “snap election” not seen in 200 years in U.S. history will be launched.
According to the Twelfth Amendment to the U.S. Constitution, in the event of an electoral college deadlock, the House of Representatives will elect the President of the United States on a “one state, one vote” basis. Reichlin said that if Pence acts, he could, by law, require those states to send accurate Electoral College voting certificates immediately by Jan. 6. But for now, that requirement seems almost impossible to fulfill.
Currently, seven states have sent different lists of Electoral College members to Congress, in addition to the numerous allegations and evidence of widespread fraud presented by President Trump’s legal team and by independent lawyers and witnesses across the United States.
In addition, Republicans in Pennsylvania and Arizona have asked the U.S. Congress not to accept the electoral votes assigned by the state’s secretary of state because they represent fraudulent election results.
Essentially, Pence could force state legislatures to reaffirm their constitutional right to convene and personally appoint electoral college votes, Reichlin told National File. Because the Supreme Court did not resolve the issue, it forced the state legislatures to reach out, and Pence could forcefully restore the legislatures’ constitutional authority to take back their mandate to appoint the Electoral College.
Reichlin argues that if Pence refuses to accept the electoral college in these states, the Constitution would allow the electoral votes in these states to be struck, and the number of electoral votes needed to win would be drastically reduced from 270. Trump would win with a simple majority of 232:227 votes, without having to trigger a voting by 1 state with 1 vote to determine the outcome of the election (contingent election).
