The U.S. Supreme Court on Dec. 11 dismissed Texas’ case against four swing state elections as unconstitutional, and President Trump (Trump) tweeted, “The Supreme Court has let us down. No wisdom, no courage!”
On December 11 EST, the U.S. Supreme Court dismissed Texas’ election lawsuits challenging Georgia, Michigan, Pennsylvania and Wisconsin on the grounds that Texas lacked legal standing to bring the cases under the Constitution.
Nine justices of the federal Supreme Court, only two of them, Justices Samuel Alito and Thomas, favored taking the case. They issued a statement saying they reserved the plaintiffs’ right to file a complaint, while expressing no opinion on any other issue in the case.
President Trump tweeted in response to the high court’s ruling, “The Supreme Court has failed us. No wisdom, no courage!”
Trump had called on the Supreme Court justices and the legislature to have the courage to do the right thing at the White House on the 8th.
“Let’s see if somebody has the courage, whether it’s a lawmaker or a legislature, or a Supreme Court justice, or multiple justices on the Supreme Court. Let’s see if they have the courage to do what everybody in this country thinks is the right thing to do.” Trump said.
Trump added: “Hopefully, the next administration will be a Trump administration because you can’t steal hundreds of thousands of votes.”
The Supreme Court ruling disappointed many Trump supporters, with Texas Attorney General Ken Paxton, who filed the lawsuit, saying, “It is unfortunate that the Supreme Court decided not to take this case and did not determine whether the four states’ failure to comply with federal and state election laws was constitutional.”
But he vowed, “I will continue to work tirelessly to defend the integrity and security of elections and to hold accountable those who would overturn established election laws for their own benefit.”
The Republican Party of Texas also issued an emergency statement condemning the high court’s ruling and calling on all constitutionally compliant states to unite and form a constitutional coalition.
Texas Republican Party Chairman Allen West told the press that the court’s decision means states “can violate the U.S. Constitution and not be held accountable. “This decision will have a profound impact on the future of our constitutional republic.”
Trump attorney Giuliani said in an interview with Newsmax TV on Nov. 11 that the Supreme Court wants to stay out of it and “they don’t want to give us a chance to hear the facts, they don’t want the American people to hear them.”
“This is a terrible, terrible mistake. Unless it’s addressed, these facts will continue to be a public sore in our history. “Giuliani said, “They need to be heard, they need to be aired, someone needs to make a decision about whether they’re true or false, and some court needs to have the courage to make that decision.”
Giuliani said President Trump’s legal battle against fraud will continue.
In an interview with Newsmax TV, retired Harvard law professor Alan Dershowitz said he agreed with Justice Samuel Alito and Justice Clarence Thomas that Texas does have standing to sue the four swing states.
Dershowitz said the Supreme Court just didn’t want to deal with, what might be considered, a political matter.
He argued that the Supreme Court’s decision sends a message that the majority includes three justices appointed by President Trump who have said they don’t intend to get involved in this election. “The Supreme Court does not want to get involved in this election battle.”
At the same time, Dershowitz praised the Trump legal team for doing an excellent job “in bringing this case to court in a creative way and making it known to the American people.”
