Beijing launches new “stall” rules to emphasize not “street vendor economy”

Beijing has introduced new rules on “stalls”, allowing temporary occupation of public space for distinctive business activities, the official interpretation of which is that this is not the “street vendor economy”.

The Beijing News reports that six departments, including the Beijing Municipal Bureau of Commerce, have issued “Opinions on the Work of Temporary Occupation of Public Space for Special Business Activities During the Normalization of Epidemic Prevention and Control”, which states that during the normalization of epidemic prevention and control, compliant enterprises can temporarily occupy public space and set up stalls in “defined time and defined area” with “limited categories”.

Chinese Premier Li Keqiang proposed the “street vendor economy” at the National People’s Congress and the Chinese People’s Political Consultative Conference this year, but in less than ten days, comments against the street vendor economy have been published on everything from the Beijing Daily to CCTV. This is why a commentary said “Li Keqiang’s street stall, ten days on closing”.

Who is allowed to temporarily occupy public space for special business activities? Can an ordinary person just walk down the street and set up a stall? According to Beijing’s newly proposed Opinions, legal enterprises that have settled in the shopping district, special consumption district, pedestrian street district, commercial complex and other areas can carry out food and beverage and other special consumption activities within their own land (red line) of the shopping district, special consumption district, pedestrian street district and commercial complex and within the reasonably planned business area in accordance with the government’s designation.

Among them, enterprises temporarily occupying public space shall hold valid licenses; catering enterprises shall not engage in food processing and production, grilling food, making beverages, etc. in the open air environment.

The Beijing Daily pointed out that the temporary occupation of public space for special business activities in Beijing is significantly different from the “street vendor economy” that has attracted much attention.

The official interpretation of the proposal is that, in addition to being a phased measure during the normalization of epidemic prevention and control, it also delineates business areas, limits business hours and categories, and strictly prohibits the occupation of city roads for business, not the “street vendor economy” of haphazard display.

The “Opinion” also proposes that the temporary occupation of public space for special business activities, classification management and “who agrees, who manages” principle, the implementation of municipal, district, street township management, in accordance with municipal guidance, district-level co-ordination, the implementation of the principle of streets and towns.

Beijing has selected Wangjing small street, Qianmen Street, Bai Rong World Trade, a total of more than 60 points, the organization of the characteristic business work. Next year also plans to 16 districts, respectively, selected 2 to 3 streets as a model street pilot.
