While the alarming ecological damage is distressing, the real estate developers concerned advertise with great fanfare: “Yunnan’s poetic spring scenery is hidden in the living room of the Longwaist Mountain Villa,” “with the best view of the Dianhai Sea,” “with the Dianhai Sea With the Dianhai Sea, with the mountains and the sea as neighbors” …… Dianchi scenery is packaged as an exclusive selling point of the villa.
On May 6, the Ministry of Ecology and Environment publicly informed Kunming Jinning long waist mountain overdevelopment seriously affects the integrity of the Dianchi ecosystem. The report said that around Dianchi “around the lake development” “close to the line development” phenomenon is prominent, the long waist mountain area by the real estate development project encroachment, some projects directly encroach on Dianchi protected area, squeezing the ecological space of Dianchi.

“Do you know that the house is being built across the street?” “Know ah, there were trees, built a house landscape is not good, annoying!” …… This is a dialogue between comrades of the Central Eighth Ecological Environmental Protection Inspectorate and local citizens of Dianchi in April this year. The “house” that the public complained about is precisely the real estate project developed in the guise of tourism and recreation on Long Waist Mountain.
The Central Eighth Ecological and Environmental Protection Inspectorate sunken inspectors found that since January 2015, Kunming Norstar Enterprise (Group) Co., Ltd. in the long waist mountain area, one after another to start construction of Dianchi International Health and Pension Resort project. According to the investigation, the project is planned to cover an area of 3,426 mu, accounting for about 92% of the total area of Changshang Mountain, with the planned construction of 813 villas, 294 multi-storey and mid-rise buildings and a construction area of 2,252,000 square meters. Among them, 390 villas and 25 multi-storey and mid-rise buildings are planned to be built facing Dianchi area.

In the briefing, the central inspection team pointed out that there are three major problems.
The 2013 version of the Yunnan Province Dianchi Protection Regulations stipulates that new construction, alteration and expansion of buildings and structures are prohibited in the primary protection zone of Dianchi; the secondary protection zone can only develop and build ecological tourism, cultural and other construction projects, and other real estate projects are prohibited. Jinning District and Nostrad Group destroyed ecological forests in Dianchi Primary Protection Zone to build an asphalt road, and successively developed and built real estate projects in the restricted construction zone of Dianchi Secondary Protection Zone in violation of the law, and completed 167 villas covering an area of 293 acres and a construction area of 108,000 square meters by July 2018.
Playing rubbish for real estate development. Under the guise of healthy retirement industry, Nostrad Group started construction of 437 villas in the restricted construction zone of Dianchi Secondary Protection Zone, covering an area of 1,242 mu and a construction area of 400,000 square meters. The real estate right certificate of these villas is listed as “marketable commodity house”, which is not a healthy pension project, but a real estate development in the name of healthy pension industry.
The ecological function of Changsha Mountain is basically lost. In addition to the real estate project located in the Dianchi Secondary Protection Zone, Nostrad Group has also built 209 villas, 294 multi-storey and mid-rise real estate projects in the Longwaist Mountain Tertiary Protection Zone, covering an area of 1,891 mu and a building area of 1,744,000 square meters, and the entire Longwaist Mountain has been developed. The site investigation found that a large number of retaining walls have seriously damaged the topography of Changshaoshan, and all the original ditches and streams have been hardened by cement, and all the woodland, grassland and cultivated land have been turned into cement land. More than 90% of the long waist mountain area is crowded with dense buildings, the entire mountain is wrapped in steel and concrete, basically lost the ecological function.

“Clear” golf course illegal existence of more than 10 years, the local raids planting trees false rectification
The long waist of the mountain suffered from brutal development, which is not a case around Dianchi. The company’s main business is the development of a new product, a new product for the company. Since 2015, the Caohai area has developed and built 42 plots of land, covering an area of 2,463 mu.

On the east bank of Dianchi, there is even a golf course covering 703.64 acres. All areas of the course’s No. 5 and No. 12 fairways, and parts of the No. 4, No. 6 and No. 11 fairways, are located within the Dianchi Primary Protection Zone, encroaching on the protected area of 456.68 mu.
In January 2004, the State Office issued a “notice on the moratorium on new golf courses”, clearly requiring that “local people’s governments at all levels and departments of the State Council shall not approve the construction of new golf course projects.” Ltd. to “outdoor tourism and leisure park” in the name of the project, land planning, construction, environmental impact assessment and other procedures, the actual construction of the Mingzhen golf course, and put into operation in May 2010.
In 2011, the state began to carry out the “clean golf” work. According to the regulations, the course should stop operating. But the course has not implemented the requirements, long-term illegal operation. In October 2015, the Kunming Municipal Government delineated the scope of the Dianchi Protection Zone at all levels, and the relevant departments issued a notice requesting the course to “immediately cease operation and withdraw from the Dianchi Primary Protection Zone”, but it refused to withdraw. Until the end of 2018, the owner only symbolically planted a few trees on the course within the primary protection zone, and the course function was not eliminated in an attempt to muddle through.
On April 11, the management committee of Kunming Dianchi National Tourism Resort took emergency measures to eradicate part of the course that was encroaching on the first level of the Dianchi Protection Zone, and planted trees on the eradicated course. In order to show the progress and effectiveness of the rectification, the management committee falsified the situation by inserting tree branches into the shallow topsoil, pretending to plant trees to falsely rectify the situation.

The inspection team noted that the trees planted in the course raid were very thin and were planted around the perimeter of the tee, the basic function of the course was not eliminated, and the ecological impact of the sand and soil under the course still existed. During the previous mapping, they also found people playing on the course.
“The Kunming Dianchi National Tourism Resort District Management Committee is not fulfilling its main responsibility, providing ‘protection’ for its long-term illegal violations.” The staff of the Central Eighth Ecological Environmental Protection Inspectorate said. in May 2011, the management committee concealed the fact that the course had not obtained legal approval procedures when it reported to the Kunming Development and Reform Commission for cleanup and remediation. in 2017, after discovering that it was encroaching on the Dianchi Primary Protection Zone, the management committee reported to Kunming from 2018 to 2020 in its “Qinggao ” self-inspection and self-inspection reports, it still did not report the situation truthfully and did not seriously supervise the rectification.

There are systems not implemented, there are responsibilities not fulfilled, there are inspectors not rectified, to achieve green development is still a long way to go
The Yunnan Province Dianchi Protection Regulations, which came into effect on January 1, 2013, divided the entire Dianchi watershed into primary, secondary and tertiary protection zones and urban drinking water source protection zones, and implemented zoning protection.
In July 2018, the first round of central ecological environmental protection inspectors “look back” pointed out that the Regulations are unclear about the construction of Dianchi protection facilities allowed in the primary protection zone, and the construction of “ecological tourism and cultural construction projects” allowed in the secondary protection zone, and the construction of “ecological tourism and cultural construction projects” prohibited in the secondary protection zone. “and prohibited construction of “other real estate projects” is also not clearly defined.
In November 2018, the Standing Committee of the Yunnan Provincial People’s Congress revised and adopted the Regulations, which clearly define the projects that can be built within the restricted construction areas of the primary protection zone and secondary protection zone of Dianchi Lake upon approval.

However, the local implementation of the system is not in place and has deviated, even bypassing the Regulations to engage in large-scale mining and development. For example, Nostrad Group openly carries out real estate development in the name of healthy retirement industry; Kunming Mingzhen Sports Tourism Company secretly builds a golf course in the name of “outdoor tourism and leisure park”.
The Ministry of Ecology and Environment pointed out in the briefing that the local party committee and government do not have a high political stance, not resolute in the protection and management of Dianchi, not high standards, not strict requirements, only small accounts, not big accounts, only immediate accounts, not long-term accounts, not properly handle the relationship between development and protection. Kunming City is late to the “Yunnan Province Dianchi Protection Regulations” requirements for the preparation and introduction of Dianchi protection planning, resulting in long-term protection of Dianchi no “rules” to follow, Dianchi “around the lake development” “posted line development The phenomenon of “development around the lake” and “development on the line” of Dianchi has become more and more intense. Yunnan Province, the relevant functional departments are not in place to perform their duties, did not timely point out and stop the Dianchi long waist mountain and other areas of illegal development and construction problems.
What is even more outrageous is that there are inspectors who do not rectify the situation. As early as July 2016, the first round of central ecological environmental protection inspectors had pointed out that the project constructed by Nostrad Group had encroached on the Dianchi primary protection zone. But not only did Jinning District and Nostrad Group not seriously learn the lesson, but also intensified.
The Ministry of Ecology and Environment (MOE) has been reporting on such cases frequently in the recent past. For example, after the first round of central ecological environmental protection inspectors informed Chaoyang City in Liaoning Province of problems in the harmless disposal of household sludge, the Chaoyang Municipal Party Committee and Municipal Government held 12 meetings to study the matter, but “only listened to the stairs but did not see people coming down”, and the work was stuck in research and never implemented, and was notified again in May 2021 Exposed.

The city of Kunming invested more than 1,700 people to carry out rectification, discipline inspection and supervision organs set up a verification team to investigate the situation
“At present, projects under construction in the secondary protected area of Dianchi Mountain have begun to be dismantled, and the greening and revegetation of the mountain is being carried out in parallel.” Ecological environmental protection inspectors are not only a “microscope” to find problems, but also a “scalpel” to cure chronic diseases. After the inspectors found that Dianchi “around the lake development” and other issues, the local rectification work was quickly carried out.
On May 2, Yunnan Provincial Party Committee Secretary Ruan Chengfa, Governor Wang Yubo led a team to the Dianchi protection and governance of Kunming City to carry out on-site supervision, proposed to speed up the construction of pipe networks and sewage treatment facilities, as soon as possible to reduce the pollution load into the lake; to resolutely rectify the excessive development of the long waist mountain, as soon as possible to restore ecological functions; to learn from the past, comprehensive regulation of the protection and governance of Dianchi; to rectify the problems found by the inspectors as an opportunity to To continue to improve the quality of the urban ecological environment. Subsequently, the city of Kunming invested more than 1,700 people to carry out rectification and demolition of buildings in the secondary protection zone of Dianchi Mountain.
In Yunnan Province, Kunming City on the “Dianchi mess” to rectify the same time, discipline inspection and supervision organs based on their functions to strengthen political oversight. This year, the Kunming Municipal Commission for Discipline Inspection and Supervision organized the investigation and verification of complaints reported by the central ecological and environmental protection inspectors and accountability work, requiring from raising awareness, increase supervision, classification and disposal, accurate norms and prudent accountability to do a good job of supervision and discipline accountability and supervision and investigation and disposal of the central ecological and environmental protection inspectors; organization of unannounced visits to investigate suspected illegal buildings around Dianchi, and seriously investigate and deal with coping with Inspector, false rectification, perfunctory rectification and other outstanding issues, serious accountability for pollution prevention and control work incompetent performance, dereliction of duty and other acts.
For the Jinning District long waist mountain overdevelopment, Mingzhen golf course false rectification and other issues, the Kunming Municipal Commission for Discipline Inspection has set up a verification team to investigate the situation. Kunming Municipal Commission for Discipline Inspection and Supervision of the relevant responsible person said, will be ecological damage, environmental pollution issues behind the power for personal gain and other issues resolutely investigated and dealt with, and joint efforts to pass the environmental protection inspector feedback problems in the rectification of the blockage of difficult points, to promote the effective rectification of the problem.
