Surrounding the police chief case: Huang Zhifeng and others about to go to jail, but no remorse in their struggle

Former Hong Kong People’s Volunteers Secretary General Huang Zhi Feng and members Zhou Ting and Chairman Lin Langyan have been charged with inciting, organizing and participating in an unauthorized assembly in connection with the siege of police headquarters on June 21 last year. The case was heard at the West Kowloon Magistrate’s Court on Monday, with the three pleading guilty to the charges, expressing no remorse for their struggle and calling on Hong Kong people to support each other in the trough of the pro-democracy movement. The court found the three guilty and ordered the immediate return of the scabbard until next Wednesday (Dec 2).

In the case of the siege of police headquarters on June 21 last year, Chow earlier pleaded guilty to two counts of “participating and inciting others to knowingly participate in an unauthorized assembly”, while Wong Chi-Fung and Lam Long-Yan denied all charges. The two pleaded guilty after hearing legal advice, and the three met with the media before going to court.

Zhou Ting said he was uncomfortable with the prospect of going to jail for the first time in his life, but called for continued attention to his siblings.

Zhou Ting said: “There is a possibility that I may have to face my first prison sentence today or in the near future, I have a lot of anxiety about the unknown future, including the future verdict, but I hope that we will not forget that there are many brothers and sisters who have sacrificed more than us, and they may be facing a more difficult situation. Friends all over the world, in addition to the three of us, continue to show solidarity and concern for the different siblings, including the 12 who are being sent, including many of you who face heavier culpability, heavier and more serious judicial proceedings.

Lam said he was ready to return the scabbard and even go to jail immediately, but had no regrets about his fight.

The case was handled by Magistrate Wong Sze-lee; Wong Chi-fung and Chow Ting were represented by barrister Locke Ying-kam, while Lam Long-yen was represented by barrister Tam Chun-kit.

The court played a clip of the incident on that day, and the prosecution read out its case in court, saying that Huang Zhifeng “organized an unauthorized assembly of the police chief to play an active and leading role,” and quoted several paragraphs of a speech he made on June 21 last year with a loudspeaker in his hand, including demanding the presence of the police commissioner and withdrawing the definition of riot.

The company also said it unlocked Huang’s cell phone and found that he had sent a Telegram message the day before, mentioning the siege of police headquarters and detailing the timeline, including calling on citizens to rush to the police headquarters and turning on a projector to play police riot footage.

The three pleaded guilty in court to “inciting others to knowingly participate in an unauthorized assembly” for unlawfully inciting those present at Harcourt Road in Admiralty on June 21 last year to participate, or to continue to participate, in an unauthorized assembly.

Wong Chi-fung also pleaded guilty to another count of “organizing an unauthorized assembly” for organizing an unauthorized assembly outside the main entrance of the police headquarters on Arsenal Street in Wan Chai on the same day. As for the other count of “knowingly participating in an unauthorized assembly,” it was alleged that Wong Chi-fung and Chow Ting participated in an unauthorized assembly on the same day outside the Wanchai Police Headquarters.

The lawyer who represented Wong Chi-fung and Chow Ting, Lok Ying-kam, pleaded for leniency in the court, describing them as “legally guilty, but the individual penalties can be considered”, including the violence involved and the degree of participation, etc. He understood that people with different political views would have different perceptions of the siege, but in any case, the court is not making a political decision, and it depends on the facts of the case and the involvement of the case. The two of them are young people. He said that Huang Zhifeng behaved mildly, and when calling on the public to surround the police headquarters, he would also ask people to make way for injured cars and cabs to cross the road; and Zhou Court has no record, etc.

The magistrate, after hearing the defense’s plea, said he needed time to review the footage of the incident and did not ask for any report for the defendants. The magistrate said that since the court had pleaded guilty earlier, the sentence was reduced by one-third. The court said that the defendants were not allowed to go out on bail because of the graduation ceremony of Huang Zhi Feng on December 4. The magistrate said he would sentence the boy earlier than that date, scheduled for December 2, when the three boys return the scabbard. Big boy: “I know it’s tougher out there for you guys.”

Dozens of citizens were present outside the court, including Cardinal Joseph Zen, Bishop Emeritus of Hong Kong, Leung Kwok Hung, a member of the League of Social Democrats, and Yuan Jiawei, a former member of Public Opinion. Police officers set up a cordon outside the courthouse to separate the entrances and exits of the media and vehicles. As the prison van left the courthouse, a large number of supporters raised “May Day” signs and chanted slogans, while some citizens chased after the van and waved goodbye.

In a social media post, Huang Zhifeng said the day before the trial began (Sunday, December 22), the three decided to plead guilty to all charges after reviewing the prosecution’s testimony and consulting with their lawyers.
