Lai Chi-ying “still owes” the government two crimes: conspiracy against a foreign country and obstruction of justice

The new charge alleges that between July 1, 2020 and February 15, 2021 (both dates inclusive), Lai Chi-ying conspired with Chan Tsz-wah, Mark Herman Simon, Lee Yu-hin, Lau Cho-dee and others in Hong Kong to request a foreign state or foreign agency, organization or person to impose sanctions, blockade or take He is also accused of conspiring with foreign countries or foreign organizations, persons to impose sanctions, blockade, or take other hostile actions against the Hong Kong SAR or the People’s Republic of China. He is also alleged to have conspired with Chan Tsz Wah, Lee Yu Hin and others in Hong Kong between a certain date in July and August 23, 2020, both dates inclusive, with the intent to do one or a series of acts that would tend to obstruct the course of justice, namely, to assist Lee Yu Hin to leave Hong Kong after he was arrested by the Hong Kong Police Force. Defendants Lai Chi-ying (73), Chow Tat-kuen (63) and Wong Wai-keung (59) are also charged with one count of fraud, and the police case manager in this case is Senior Inspector Fung Chun-yee of the National Security Branch.

The charge alleges that the three defendants, between June 27, 2016 and May 22, 2020, in Hong Kong, by deception, namely (1) concealed from the Hong Kong Science and Technology Parks Corporation (“HKSTPC”) that there was not, or had not been, a lease between the Hong Kong Industrial Estates Corporation (now HKSTPC) and Apple Daily Printing Limited in 1999 (“the Lease”) dated 25 May 1999 and entered into between HKIEC (now HKSTPC) and Apple Daily Printing Limited (“the Company”), and used the premises at 8 Chun Ying Street, Tseung Kwan O Industrial Estate (“the Premises”) or part of the Premises (2) falsely represented to HKSTPC that, as permitted under the Lease, the Premises or the Premises were or had been used or part of the Premises as permitted under the Lease; and with intent to defraud, induced HKSTPC to commit an omission or series of omissions, i.e. failure to act to enforce HKSTPC’s rights under the Lease, resulting in a benefit to Apple Daily Printing Limited and/or Lico Consultants Limited; or causing HKSTPC to suffer a disadvantage or a substantial likelihood of suffering a disadvantage.
