In response to the U.S. Senate’s impeachment hearings, which begin Feb. 9, Trump lawyers filed a brief on Feb. 8 saying Trump should not be held responsible for the Jan. 6 Capitol Hill riot. But they also said the hearing gives them a chance to explain to senators why this impeachment of an ordinary American citizen is absurd and unconstitutional, and they welcome the opportunity.
According to the Washington Times, Trump’s lawyers, David Schoen and Bruce Castor, noted in their brief filed on Feb. 8 that the impeachers still suffer from “Trump confusion syndrome,” even though Trump left office on Jan. 20. And the second impeachment of Trump is a “political war.”
Trump’s lawyer: impeachment is a political weapon
Trump’s lawyers said the impeachment could also lead the Republican Party to similarly use impeachment as a political weapon, banning people like Biden or Hillary from ever entering the White House again.
Trump’s legal team said the latest impeachment document submitted to the Senate seeks to develop a mechanism by which they can silence political opponents and minority parties, and that the Senate must “immediately reject this brazen political act.
The Trump camp also rescinded its original request for the impeachment hearings to avoid the Jewish Sabbath on the 8th.

The House of Representatives approved the impeachment of Trump on January 13, accusing him of instigating a riot. The House’s impeachment manager said on the 8th that the Senate must convict Trump to prevent him from holding public office again.
Trump’s lawyers said in a brief on the case that such a statement by the House impeachment manager is comical because it is the American voters who have a say in the candidate who will take the White House.
They wrote: “This idea of the House (impeachment) manager is almost laughable because they have spent the last four years pretending that Trump’s presidency is illegitimate and invalid, and now are so concerned that he might rise again that they are trying to illegally undermine him (the possibility of re-election).”
“‘Resistance’ is symbolic
The lawyers also said the “resistance” used by Trump in his Jan. 6 speech to his supporters was symbolic. Those who have criminally violated Capitol Hill rules have done so of their own volition and for their own reasons, and they are being criminally prosecuted.
The summary also condemns the callousness of some leftist leaders in exploiting the fear and confusion caused by the riots that broke out on Jan. 6 for the benefit of their party. Timeline could confirm Trump didn’t start riots
The lawyers wrote: “A simple timeline would show that the riot was not triggered by the president’s speech on the Oval Lawn.”
They also cited that after hearing reports of violent clashes, Trump took to Twitter to plead with his supporters to remain calm and peaceful. Then, Trump posted another video on Twitter urging his supporters to go Home peacefully. And Trump and the White House took further immediate steps to coordinate with authorities to provide the necessary measures to counter the thugs.
The summary reads that there is no legitimate evidence, nor will there ever be, that Trump is “happy” about the riots on Capitol Hill. He, like the rest of the American people, was shocked by the violence that took place.
White House spokesman Jen Psaki said Biden was “too busy to watch the impeachment process,” and that Biden was not involved in the Feb. 8 negotiations between several parties on the impeachment process.
According to the parties’ negotiations, the Senate will spend the afternoon of the 9th deliberating whether to reject the impeachment for four hours. Impeachment hearings will then begin at noon on the 10th, and both the House impeachment manager and Trump’s defense attorneys will have 16 hours to make their case. If approved by a majority of senators, the House’s campaign manager will be able to call witnesses.
The House approved the impeachment resolution against Trump on Jan. 13, 232 to 197. However, almost all analysts estimate that the Senate’s impeachment of Trump will be as unsuccessful as the first impeachment of Trump in 2020, because the Senate will need 2/3 of the Senators to convict Trump, which means it will take 17 Republican Senators to support the conviction of Trump, but the likelihood of that happening is slim.
