After a three-month investigation, New York State District Judge Scott DelConte issued his ruling on February 5. Claudia Tenney, the Republican candidate, was elected to the U.S. House of Representatives representing New York State’s 22nd District. Tenney became the last member of the House of Representatives to be elected one month after the new U.S. Congress was inaugurated. The Republican Party added another seat.
According to reports, Judge DeCondais ruled on February 5 that Republican candidate Tenney, with 109 votes, defeated Democratic Congressman Anthony Brindisi, who was seeking re-election, to represent the 22nd congressional district in central New York.
Turney previously served as the congressional representative for the district until he was defeated by Brindisi in 2018.
In the 2020 election, New York’s 22nd district became the most competitive, and on election night, Nov. 3, Tenney had a significant lead over Brindisi with 28,422 votes, but after absentee ballots were counted, anomalies occurred in the vote count and a large number of ballots were not properly counted or were improperly discarded.
At one point during the count, the lead between the two narrowed to 300 votes, with Turney narrowly ahead, but the state’s race suddenly shifted to Brindisi’s lead after a large number of absentee ballots were counted by the Election Commission.
Because of anomalies in the vote count that led to the disputed results, Tenney and Brindisi went to court. The judge spent three months reviewing the ballots and trying to resolve the many problems that arose in the tabulation of the ballots.
On Nov. 30, the last day for election officials in the 22nd district to present the district’s results, more than 2,000 disputed absentee ballots and sworn ballots were still found to be waiting for a judge to rule on their validity.
The ruling came after a three-month period in which the judge reviewed ballot challenges and fixed numerous problems with the ballot tabulation process. For example: seven of the district’s eight election boards were found to have made serious errors in failing to comply with and perform their statutory duties on affidavits, absentee ballots, military ballots and special ballots.
In the end, DeCondais ordered New York State to immediately certify the ballot results and declared that Turney won by a margin of 109 votes, so Turney will be sworn in.
De Condé said his role as a judge is to “make sure everyone follows the law. He also rejected Brindisi’s lawyer’s argument that election officials should immediately certify the results. This could clear the way for Tenney to be sworn in and avoid the urgent intervention of the appeals court.
Brindisi said he was “shocked and surprised” by the latest Decondet ruling and hoped to delay certification of the results until the appeals court had a chance to review the case.
Democrats currently control the majority of 221 seats in the 117th House of Representatives, while Republicans are the minority party with 211 seats. According to Congress’ website, there are currently two open seats in Congress – due to death and resignation, respectively.
There is much confusion and anomalies in the 2020 U.S. election, especially the presidential election, which has seen massive electoral fraud in swing states and is believed to be rigged by the far left and the Chinese Communist Party in the United States.
