California Congressman Garcia: Will vote down electoral votes

On January 3, Representative Mike Garcia of California’s 25th District was sworn in to Congress in Washington, D.C. On January 4, Garcia tweeted that he would vote down certain states’ electoral votes at a joint session of Congress on January 6.

The responsibility of elected officials to represent

In the statement, Garcia said, “It is constitutionally inferred that the federal legislature (Congress) is the ultimate review of the actions or procedures of state legislatures, and our republic is built on this mechanism of checks and balances.”

“I am convinced that there is sufficient evidence that the process and integrity of elections in certain states has been compromised and that the integrity of elections has been undermined, and that we need a full audit of elections in several states to assure the confidence of the American people in elections.”

“The period around the 2020 election is the most divisive and polarizing in America’s short history, and I have reviewed the evidence and the constitutional arguments of both sides in the current contested states and see that in at least six swing states, state election laws have been fundamentally altered by state bureaucrats, thereby violating the clear powers granted to state legislatures by the federal Constitution. “

Garcia argues that these (changes) violate Article II, Section 1, Clause 2 and Article I, Section 4 of the Federal Constitution, as well as the procedures for directing voters and administering elections, and that there should be no gray areas in this regard. The legislatures and attorneys general of these states allowed this flawed process to emerge and develop, defeating the election.

“The failures in these six states are not only a disservice to the two presidential candidates, but also an affront to people’s national pride and founding platform, and these doubts now come to Congress and will be decided by Congress.”

Garcia said he in no way took the decision lightly, “I have no blind loyalty to any individual or political party. The purpose of my opposition is not to change the outcome of the election; fraud in elections is unacceptable and must be eradicated.”

“I serve and fight for the Constitution, which means the integrity of the election process and the election of federal officials is infallible. If the people question the integrity of the election, we have a moral responsibility, as elected officials and representatives at all levels, as well as a constitutional and legal obligation. We need to slow down and check in to see what really happened.”

Garcia emphasized, “The Jan. 6 vote is not about Trump (Trump) or Biden, or the left or the right, it’s about securing the election. We need to count every legal vote and remove every illegal or fraudulent vote, not only for the sake of the election now, but for the future. Just as we need to make sure that foreigners don’t play tricks in our elections, it is equally important that we make sure that we can have a system that is trustworthy and legitimate on our own soil.”

Fighting for national security

In May 2020, Garcia defeated Democrat Christy Smith, 54.9 percent to 45.1 percent, in a special election held in response to the resignation of a Democratic lawmaker amid a sex scandal; in the November general election, Garcia won again (50.0 percent to 49.95 percent). Garcia now serves on three House committees: Transportation and Infrastructure; Science, Space and Technology; and Homeland Security.

I will continue to fight to keep our state safe, ensure our veterans and service members receive the rights they deserve, reduce government regulation and red tape, and ensure Californians have the resources and support they need to respond to COVID-19 and safely open up the economy,” Garcia said. I thank my constituents for their trust, and I look forward to working for them.”

Garcia is a former U.S. Navy fighter pilot, businessman, and conservative with a bachelor’s degree in political science and a master’s degree in national securities research; he served as a fighter pilot on the aircraft carrier USS Nimitz after 9-11, participated in combat operations against Iraq, served nearly 20 years and flew 1,400 hours, and served as an executive at Raytheon for 11 years after his honorable discharge.

In November 2020, Garcia was a guest speaker at the Reagan Library Veterans Memorial Day event, where he said, “We are blessed to live in the greatest nation on this planet, and for 244 years American patriots have fought for freedom, not only on American soil, but have led the way in the pursuit of happiness and liberty around the world. Twice we have defended democracy from tyranny in Europe; during the Cold War we have fought terrorism and eliminated the Caliphate (Caliphate or ISIS).”
